The Federal Senate approved, this Tuesday (24), the provisional measure that provides for the possibility of a Federal Police agent receiving cash payment for being on call, through a change in the allocation of resources from Funapol (Fund for Equipment and Operationalization of the Federal Police’s core activities).
The text, which would be valid this Wednesday (25), was approved by a symbolic vote, without any changes in relation to what was approved by the Chamber of Deputies, and now goes to the Presidency’s sanction. The rapporteur, Styvenson Valentim (Podemos-RN), rejected the only amendment that was presented.
Currently, the supplementary law that deals with the fund says that the annual plan prepared by the management board in the second half of the previous year can allocate up to 30% of the revenue to pay expenses with displacement and maintenance of police officers in official operations.
The new text provides for the allocation of up to 50% of resources to transport, accommodation and food for servers on official mission. The money can also be used for health and payment of compensation to the PF employee who voluntarily fails to fully enjoy paid rest, remaining available for the service.
Today, that police officer only has the option of taking the day off. With the MP, he can choose to be on call and receive cash. The intention is to try to increase the number of personnel available for police operations, even if the option for the benefit is voluntary.
Compensation may be granted to the public servant who remains at the disposal of the PF, according to a previously prepared schedule, awaiting a call to report to the service, after the regular workday of 8 hours a day or 40 hours a week.
According to the text, the hours of availability of the server will be compensated on another day or may be paid by regulation of the general director, in the amount of 1/3000 of the highest remuneration of the police career, per hour.
The compensation will be regulated by an act of the Minister of Justice, who will establish the conditions and criteria necessary to receive the benefit. It will be up to him to determine the limits for payment and receipt of the availability indemnity per server.
This amount, according to the MP, will not be subject to income tax and social security contribution. Nor can it be incorporated into the employee’s salary or used as a basis for calculating retirement or pension for death.
The text opens up the possibility of a regulation expanding the range of expenses related to the Federal Police’s core activity that can be the result of the allocation of funds from the fund.
The funds to pay the compensation will come from the reallocation of the Federal Police’s budget allocations.
