Retirees and other policyholders who won a lawsuit against the INSS (National Social Security Institute) in court and had the payment order for arrears issued by the judge in October this year will receive the money soon. The federal court released, this Monday (22), R$ 1.33 billion to pay 73,198 policyholders, winners of 71,852 processes.
The payment of RPVs (Small Value Requisitions) — up to 60 minimum wages, in other words, R$ 66,000 in 2021 — is made month by month, according to the budget of the CJF (Federal Council of Justice). Considering all arrears payments, which include social security actions and other actions, 160,030 citizens will receive a total of R$ 1.596 billion.
For policyholders in São Paulo and Mato Grosso do Sul, assisted by the TRF-3 (Federal Regional Court of the 3rd region), the amount released will go to settle the INSS debt in 6,614 social security processes, with 8,043 beneficiaries, totaling the payment of R $162.3 million.
According to TRF-3, the processing of RPVs has already started and, with this, the forecast is that the payment of amounts is made within seven days, that is, until next week. The processing phase is when the court opens the accounts for depositing the amounts at Caixa Econômica Federal and at Banco do Brasil
The money is released by the CJF to the courts, which follow their own schedules for depositing financial resources to citizens. Normally, it takes two months between the payment order issued by the Court and the receipt of the arrears.
INSS arrears
The insured who won a lawsuit against the INSS — for granting or reviewing a benefit, for example — may be entitled to payment of the amounts overdue, limited to the last five years.
Those who have to receive an amount of up to 60 minimum wages are paid through RPVs, but the insured who has an amount greater than R$ 66,000 receives through precatório, which leaves once a year.
The discharge of court orders depends on the annual release from the federal government. The CMO (Mixed Budget Commission) has already released the consultation of the processes whose money will be paid in 2022. The estimate is that the federal government will spend R$ 89 billion on court-ordered debts, part of which on social security.
However, the PEC dos Precatórios, currently under discussion in the Senate, may delay the payment of the review processes that pay in arrears above 60 minimum wages. The proposal will not change the right to INSS arrears or revisions, however, it may postpone the release of retirees’ money.

- For policyholders in São Paulo and Mato Grosso do Sul, the court is the TRF-3 (Federal Regional Court of the 3rd Region), whose website is www.trf3.jus.br
