Panel SA: Restaurant sector goes to court for tax exemption

The restaurant sector is preparing to go to court to request access to the tax benefits provided for in the Perse (Emergency Program for the Recovery of the Events Sector).

Last year’s law provides that companies may be exempt from federal taxes (PIS, Cofins, IRPJ and CSLL) for five years.

An ordinance by the PGFN (Attorney General of the National Treasury) limited the benefit to those who were registered in Cadastur until the date of publication of the law, in May 2021.

Fernando Blower, executive director of the ANR (National Association of Restaurants), says that the barrier has no legal support. “The resolution created a temporal limitation on the right that the law did not provide for,” says Blower.

The judicial process will be filed in the coming days, and the entity also asks for an injunction so that the effects of the decision, if positive, are immediate.
