The Chamber of Deputies approved this Wednesday (29) a provisional measure that authorizes the granting of payroll-deductible loans to beneficiaries of Auxílio Brasil up to the limit of 40% of the amount and also releases this type of credit for those who receive the BPC (Benefício de Prestação) continued).
The BPC is a benefit paid to needy elderly people and people with disabilities who prove that they are in a vulnerable situation.
The basic text was approved by 245 votes to 69. The deputies rejected suggestions for modifying the MP, which now goes to the Senate. If it is not voted on by July 15, it loses its validity.
The text says that beneficiaries of federal income transfer programs will be able to authorize the Union to make discounts on benefits in favor of banks for loan repayment. The limit is 40% of the value.
The MP says that the Union cannot be held liable, even subsidiarily, for default by the beneficiary.
The text, reported by deputy Bilac Pinto (União Brasil-MG), also extends the possibility of hiring a payroll loan by those who receive the BPC.
Beneficiaries, as well as INSS pensioners and retirees, may contract this type of credit up to a limit of 45% of the benefit amount. Of this total, 35% must be loans, 5% to pay expenses incurred with a payroll-deductible credit card or withdrawal, and another 5% for expenses with a payroll-deductible benefit card or payroll-deductible benefit card.
The text also allows workers governed by the CLT (Consolidation of Labor Laws) to hire up to 40% of their salary with payroll deduction, 35% of which with a loan and 5% for expenses contracted with a payroll-deductible credit card or withdrawal with payroll credit card.
The discount may also apply to severance pay due by the employer, if this is provided for in the loan or credit card agreement.
The MP sets at 40% the limit for deduction from salary, salary or social security benefits in consignments granted to military personnel, active and inactive public servants, public employees of direct administration, autarchy and foundation and pensioners of civil servants and military personnel.
This maximum percentage, according to the provisional measure, cannot be subject to any limitation of use by number of contracts.
The text provides for the refund of amounts unduly credited to someone already deceased, as well as discounts after the death of the beneficiary as a result of a payroll loan or payroll credit card. The rule does not apply to financial amounts received by the family related to the benefits of the Auxílio Brasil Program.
According to the text, before signing a payroll loan agreement, the bank must deliver to the applicant a statement that specifies the remaining amount of monthly net earnings, after deducting the monthly installment, as well as the interest rate, the total effective cost of the loan. and the deadline for full payment.
The MP also brings some rules on the Urban Productive Inclusion Aid, intended for beneficiaries of Auxílio Brasil who prove employment relationship with a formal contract.
The granting of Urban Productive Inclusion Aid, according to the MP, is personal and temporary and does not generate acquired rights.
In addition, an act of the Minister of Citizenship will determine the amount of the deposit, the procedures for calculating, paying and operating the deposit, criteria for prioritizing and selecting beneficiaries, rules for gradual implementation and other conditions for managing the aid.
