Didn’t receive the Trucker Aid? know what to do

More than 400 thousand truck drivers who did not receive the first two installments of the aid can still have the benefit, resolving pending issues with official bodies. The reasons for non-receipt can be consulted on the Emprega Brasil Portal or on the Digital Work Card, allowing the professional to regularize the situation.

Despite the fact that 848 thousand people meet one of the main requirements for the payment of the aid (being with the National Registry of Road Cargo Transport (RNTR-C) in force on May 31, 2022), less than a quarter (190,861) received the first two installments.

Dataprev, the public company responsible for analyzing the requirements for receiving the benefit, reports that almost 400,000 professionals had no record of road freight transport operation between January 1 and July 27, 2022.

In addition, more than 200,000 other truck drivers were not registered on July 27, had an irregular CPF with the Federal Revenue Service, received disability benefits or social support for people with disabilities, or did not meet any other requirement.

If inconsistencies are detected in the registration, such as irregularities in the CPF or with the INSS (National Social Security Institute), it is necessary to seek the respective bodies to resolve the situation before the next data processing by the Ministry of Labor and Dataprev.

Absence of registration of cargo transport operation in 2022

Solution: Fill out the self-declaration stating that you are able to carry out transport operations until August 29th.

According to Dataprev, the absence of cargo transport operations registered with the National Land Transport Agency (ANTT) between January 1 and July 27, 2022 was the main reason for the benefit not being paid, affecting 400,000 people.

Among these professionals, those with an “active” registration status on July 27, 2022 can still receive the aid, including the first two installments, by completing the self-declaration available on the Emprega Brasil Portal (servicos.mte.gov.br) or in the Digital Work Card (gov.br/pt-br/temas/carteira-de-trabalho-digital) until August 29th.

Once the conditions are met, the payment of the first two installments is scheduled for September 6th.

Professionals who meet all the requirements and make the self-declaration after August 29 will only receive the next installments, without retroactive payments.

In addition, those who had an active registration on July 22, but did not have a cargo transport record until the 27th, can receive the payment of the first two installments if they register cargo transport until August 29.

Registration in a situation other than active on July 22

Solution: Regularize the registration status in the National Registry of Road Cargo Transport (RNTR-C) with the National Land Transport Agency (ANTT).

Upon regularizing the registration status, the truck driver is able to receive the next installments of the benefit, but does not receive the payments already made.

Anyone who had a suspended or pending registration on July 22 can regularize the situation with ANTT in two ways:

  • accessing the RNTRC Digital, following the step by step provided by ANTT in the “How to obtain and update” tab of its website (https://portal.antt.gov.br/rntrc)
  • attending one of the accredited service stations for the carrier category (Autonomous Cargo Carrier – TAC), which can be checked in the “Service Points” tab on the website https://portal.antt.gov.br/rntrc

Among the documents necessary to regularize the TAC situation, are necessary:

  • official identity document with photo, preferably the National Driver’s License (CNH)
  • CPF, which must be valid and active in the Federal Revenue
  • proof of residence, such as a water, electricity or telephone bill issued no more than three months ago
  • approval in a specific course for TAC, made by ANTT directly with the companies that issue the certificate
  • CRLV (Vehicle Registration and Licensing Certificate) in force for each vehicle, cargo and rental category
  • CNH of up to two TAC-Auxiliaries registered by the TAC

Non-existent CPF, in a situation other than regular or underage

Solution: Regularize the situation with the Federal Revenue.

It is necessary to provide an existing CPF in good standing for the granting of the benefit. In addition, anyone under the age of 18 or who was not officially emancipated on May 31, 2022 at the age of 16 does not receive the aid either.

In case of problems with the CPF, it is possible to regularize the situation. First, check the exact status of your CPF at https://www.gov.br/pt-br/servicos/consultar-cadastro-de-pessoas-fisicas. The IRS informs that there are specific procedures for each situation.

If the CPF is pending regularization, it is indicative that some Income Tax Return was not delivered. In this case:

  1. See which declaration is missing from the e-CAC portal
  2. Submit the declaration through the e-CAC Portal or the Meu Imposto de Renda app
  3. After processing the declaration, which normally takes place within one day, the CPF will be regular

In case of CPF suspended, there is incorrect or incomplete information, which must be rectified through the CPF Regularization Request form on the Federal Revenue website. If a protocol is generated, it is necessary to schedule service at a unit to present your documents to the IRS or send them by e-mail, according to the guidelines available on the website.

It may happen that the CPF is registered as deceased holder, with date of death informed in the register. In this situation, it is necessary to schedule an appointment at a Federal Revenue Service unit, carrying identification documents.

Finally, the CPF can be canceled, which occurs in case of duplicity or decision in a process. If the cancellation is undue, the interested party must also schedule an appointment at a Federal Revenue Service, carrying identification documents.

Solution: Regularize the situation with a Civil Registry Office for Natural Persons.

Institutor of pension for death or reclusion aid

Solution: Regularize the situation with the National Social Security Institute (INSS).

The death pension is paid to the dependents of the INSS insured who died, who is known as the pensioner. The reclusion aid is paid to dependents of a person taken to prison, with the founder being the prisoner.

The Ministry of Labor and Welfare emphasizes that if the applicant for the benefit is characterized as having instituted one of these aids and is not actually doing so, it is probably the result of fraud. Situations like this are rare and should be reported to the INSS ombudsman or help should be sought by calling 135.

Beneficiary of the Benefit for Disability (some species) or of the BPC for the person with a disability

Solution: Regularize the situation with the National Social Security Institute (INSS).

Holders of benefits for permanent incapacity for work, Continuous Benefit Benefit (BPC) or disability do not receive the truck driver assistance.

If the person interested in assistance considers that such characterization is the result of an error, he should seek help from the INSS, calling 135.

Formal employment relationship with average salary in 2022 above 10 minimum wages

Solution: Request the employer to regularize the records with the e-Social.

One of the criteria for not receiving payment is to appear as a holder of a formal employment relationship, with an average salary in 2022 of more than 10 minimum wages.

If the professional really has the bond, he is not entitled to receive the benefit, but in case of error, it is recommended to ask the employer to regularize the records with the e-Social.

The press office of the Ministry of Labor and Welfare (MTP) points out that cases are very rare, but if they occur, it recommends that the employer corrects the error in the monthly statement.
