Former minister Aloizio Mercadante (PT) said this Tuesday (22) that the team of the president-elect, Luiz Inácio Lula da Silva (PT), is considering inserting a device in the PEC (proposed amendment to the Constitution) of the Transition that would allow a review of the spending cap through a supplementary law.

The change would pave the way for a change in the fiscal rule without the need for a PEC, which has a more complex rite and requires greater support in Congress than a complementary law.

This forecast to review the fiscal anchor existed in Constitutional Amendment 95, which created the ceiling, and established 2026 as the date. However, the device was withdrawn during the government of Jair Bolsonaro (PL).

“This device was withdrawn by the current government team when voting on the Precatorios PEC, this device no longer exists, it was postponed for the future”, said Mercadante.

“What is under discussion is this possibility, introducing a device in the PEC that authorizes a review of the spending ceiling by a complementary law in the future”, he added.

Shortly before, vice-president-elect Geraldo Alckmin (PSB) also spoke about the revision of the ceiling. “I think the ideal would be to combine the ceiling —that’s where the best formula is defined—with the evolution of the debt curve and the primary result. You make a combination of the three things.”

The senator and member of the transition team Simone Tebet (MDB-MS) also stated this Tuesday (22) that the PEC will have some kind of fiscal anchor and that it is possible to keep spending on Bolsa Família outside the spending ceiling for four years. of the Lula government.

“Some anchor will have. We will have a deadline for this, they are talking. I think we are reaching a good term”, she said, as she left the CCBB.

“We are a collective. The National Congress will have to decide on this. But I believe it has conditions to extend for four years”, he added.

The vice president-elect, Geraldo Alckmin (PSB), also announced to the press the inclusion of 99 parliamentarians in the technical groups of the transition.
