The Minister of Economy, Paulo Guedes, and the Minister of Mines and Energy, Adolfo Sachsida, have already signed the agreement closed at the STF with representatives of states, the Union and Congress to resolve the ICMS impasse on fuels.
The information was confirmed by a Finance Secretary to the column. According to him, the agreement is now on the table of the attorney general of the Union, Bruno Bianco. If it is signed, it will go to the Supreme Court for approval.
As Panel SA reported, the governors agreed with the terms defined by their technical representatives at the Supreme Court meetings.
Eleven states appealed to the Supreme Court questioning the constitutionality of the law that reduced and unified tax rates by 17%. Before it was defined by the states.
A special commission was created by Minister Gilmar Mendes to try to find a solution before the case went to the plenary.
Mendes is the rapporteur for two of the most important ADIs (Direct Actions of Unconstitutionality).
With the agreement, it will be necessary to make an agreement between states and the Federal District so that the ICMS collection is made with a single rate to be charged only in the commercialization of fuels. This deadline expires on December 31 of this year.
The settlement, however, does not apply to gasoline – which will be the subject of a separate negotiation.
