Retirees will receive R$1.5 billion in INSS arrears

INSS (National Social Security Institute) policyholders who won lawsuits for granting or reviewing benefits in court and had the money for arrears released by the judge in November will receive the amounts in the coming days.

The CJF (Council of Federal Justice) sent R$ 1.461 billion to the TRFs (Federal Regional Courts) across the country for the payment of RPVs (Small Value Requisitions), which are arrears of up to 60 minimum wages, which corresponds to R $66,000 this year.

The total amount released will pay off social security and assistance actions for retirement, pensions and aid, including the BPC (Continuous Provision Benefit), for 103,619 beneficiaries who won 79,836 processes against the INSS without any possibility of appeal.

The amount paid by the CJF is even greater, as it also involves other food RPVs, which are neither social security nor assistance, and serve civil servants’ processes against the federal government. In all, 175,336 winning beneficiaries of 142,572 shares will receive R$1.7 billion.

In the TRF-3 region (Federal Regional Court of the 3rd Region), which serves the states of São Paulo and Mato Grosso do Sul, BRL 165.7 million will be paid to 7,498 beneficiaries who won 6,427 processes.

According to the court, the processing of amounts, which is the phase in which accounts are opened for depositing arrears at Caixa Econômica Federal and at Banco do Brasil, has already begun. In general, policyholders served by TRF-3 receive the amount within seven days after processing begins.

Once this process is completed, the insured will be able to check if their name is on the payment list.

How to make the query

The consultation is carried out on the website of each court responsible for the process, depending on the region in which the insured person lives. In São Paulo, it must be done on the TRF-3 website On the home page, go to “Procedural consultation”, on the right side of the screen, in a green box. Then click on the arrow next to “Process number” and choose the option “Payment requests”.

Then, go to “Query by OAB, Process of origin, Letter Requisition of origin or Protocol number” and enter your CPF, lawyer’s OAB or the case number and click on “I’m not a robot”. Then go to “Search”; your RPV will then appear.

To find out you will receive this month, it is necessary to observe the dates that appear in specific fields. RPVs whose “TRF protocol date” is November 2021 are paid in December. After payment, “full payment to the court” will appear.

Correction of court orders and RPVs

According to the CJF and the TRF-3, the money paid this month will still not have the old correction, by the inflation measured by the IPCA-E (Special Extended Consumer Price Index), and not by the Selic rate, as determined in the constitutional amendment 113, arising from the PEC (proposed amendment to the Constitution) of the Precatório.

As of next month, for RPVs assessed in December, the correction should be applied, since the new index took effect on the 9th, the date of publication of the amendment.

“Considering Article 3 of EC No. 113/2021, which establishes that in discussions and convictions involving the Public Treasury, regardless of their nature and for purposes of monetary restatement, capital remuneration and compensation for arrears, including the precatory, there will be a single incidence, until the effective payment, of the reference rate index of the Special System for Settlement and Custody (Selic), accumulated monthly”, says a technical note from the Federal Court.
