Justice pays BRL 1.12 billion in INSS arrears; see who gets

The CJF (Conselho da Justiça Federal) released the monthly payment of arrears from the INSS (National Institute of Social Security) to the TRFs (Federal Regional Courts). The data were released on Tuesday (24). In the country, 125,942 beneficiaries will receive R$ 1.37 billion in arrears.

Of this general total, R$ 1.12 billion is allocated to processes of social security and assistance benefits, such as retirement reviews, sick pay, pensions and other benefits and 58,822 actions will be settled, with 74,326 beneficiaries.

Retirees, pensioners and other insured persons who won claims with arrears of up to BRL 72,720 are entitled to these RPVs (Small Value Claims), provided that the payment was issued by the Court in December 2022. The limit also considers the salary minimum in force in 2022.

For RPVs issued from January 2023, the limit of BRL 78,120, or 60 minimum wages of BRL 1,302, will apply to the next batch.

The date of release of the money in a Caixa or Banco do Brasil account depends on the schedule of each court where the action was analyzed. At the TRF-3 (Federal Regional Court of the 3rd Region), for example, the money is usually released in about a week in bank accounts, after receiving the amounts.

To enter one of the monthly batches of arrears, the action must have been finalized, with no possibility of INSS appeals, a stage that occurs after the final and unappealable decision. In addition, the court must have issued the payment order (called the requisition or assessment phase of the process).

WHO HAS THE RIGHT?

Insured persons who sued the INSS and won the action, and whose date of the judge’s payment order is December 2022. The process must be up to 60 minimum wages, as arrears with higher amounts become precatorios, which have a different payment system, with release in only one batch per year.

The RPVs to be paid refer to the concession or revision of:

• Retirement
• death benefit
• sick pay
• BPC (Continued Provision Benefit)

HOW TO CONSULT YOUR DELAY

• The insured person can consult the law firm responsible for the action or the website of the court responsible for the process, according to the region in which he lives
• For policyholders from São Paulo and Mato Grosso do Sul, the court is the TRF-3, whose website is www.trf3.jus.br

Step by step on TRF-3:

1. Go to “Procedural consultation”, on the right side of the screen, in a green frame
2. Click on the little arrow next to “Process number” and choose the option “Payment requests”
3. Then, go to “Queries by OAB, Process of origin, Requisitor Office of origin or Protocol number”
4. Enter your CPF, OAB of the lawyer or the case number and click on “I’m not a robot”
5. Then go to “Search”; then your RPV will appear
