Bolsonaro sanctions aid to app delivery people and vetoes inclusion in food program

President Jair Bolsonaro (PL) sanctioned this Thursday (5th) a bill that creates protection measures, such as financial aid, for app deliverers during the pandemic.

However, he vetoed the possibility of companies providing food through the PAT (Worker Food Program).

According to Palácio do Planalto, the justification is economic: the measure would result in a waiver of revenue without budgetary impact, which violates the Fiscal Responsibility Law. The sanction must be published in the Official Gazette on Thursday (6).

The PAT provides tax advantages, such as exemption from social charges, for companies that provide food or meal vouchers.

“The application and delivery company will be able to provide food to the delivery person through the worker food programs provided for in Law No. 6,321/1976”, says the text approved in Congress.

Authored by federal deputy Ivan Valente (PSOL-SP), the proposal was symbolically approved in the Senate at the end of December.

On the return of the Legislative recess, in February, parliamentarians will analyze the president’s veto, being able to overturn it.

The proposal sanctioned by Bolsonaro provides for the payment of financial aid for 15 days to professionals on leave for having been infected by the new coronavirus.

“The sanction for the project represents an important measure for the work carried out by the delivery people, given the need to ensure adequate conditions for the preservation of their health in the provision of services through a delivery application company”, says a note released by Planalto.

Deliverers even protested last year asking for fairer rates for app companies and help with basic protections during the coronavirus pandemic.

The law provides that application companies must take out accident insurance, without deductible, for couriers.

The benefit is only used for accidents that occur during the withdrawal or delivery of the product, “must cover, obligatorily, personal accidents, permanent or temporary disability and death”.

The new rule also provides that the application company must guarantee the delivery person removed by Covid-19 financial aid for a period of 15 days, extended for two more periods of 15 days, upon presentation of the receipt or medical report.

Financial assistance will be calculated according to the average of the last three monthly payments received by the delivery person.

The aid is conditioned to the presentation of proof of a positive result for Covid-19, obtained through an RT-PCR exam, or a medical report attesting to the removal.

The bill also determines that companies must provide couriers with a set of information about the risks of Covid-19 and ways to prevent and prevent the spread of the virus.

In addition, it must provide masks and alcohol gel or other sanitizing material for personal protection – whether delivering the items, through transfers or reimbursement of expenses for this purpose.

The text also provides that companies must adopt ways to seek to avoid contact of delivery people with other people during the withdrawal and delivery of products and food. Workers must also be allowed to use establishments’ restrooms and toilets and have access to potable water.

The text also says that the company supplying the product or service must adopt measures so that the delivery person does not have contact with the final consumer.
