Panel SA: Justice orders Banco do Brasil to put worker in home office

The national union movement of bank workers obtained this Wednesday (19) a provisional decision in court for Banco do Brasil to place all employees who work in commercial buildings without public service at home until the cases of Covid-19 decrease.

The injunction also determines that the bank follows its safety manual on the pandemic, which was in force until the 4th of this month.

The document required the use of a mask, the issuance of a (Work Accident Communication Registry) for all professionals contaminated by the coronavirus, the reimbursement of amounts related to the tests and the immediate closure for cleaning of agencies where there is a record of contamination.

According to the process judged in the 28th Labor Court of São Paulo, Banco do Brasil changed the protocol unilaterally, without union consent.

Through Contraf-CUT, the category triggered the MPT (Public Ministry of Labor) against BB’s decision to change the safety manual in the pandemic.

Although she pointed out that there is no way to know whether the contamination of the worker occurred at the bank branch, judge Ana Cristina Magalhaes Guedes stated in her decision that “to stop requiring the use of masks and keep employees working in person without due need, at this time, demonstrates lack of attention to the gravity of the scenario”.

Failure to comply with the determinations within 48 hours can generate a daily fine of BRL 50,000.

Banco do Brasil states that it became aware of the decision rendered in the Collective Civil Action No. 1000020-39.2022.5.02.0028 and is evaluating the adoption of appropriate measures.
