The minister Rosa Weber rejected this Tuesday (9) the action that asked the STF (Supreme Federal Court) to suspend the processing of the PEC (proposed amendment to the Constitution) of the Precatório.
The magistrate denied three different requests from opposition lawmakers, who alleged that amendments to the initial proposal had been irregularly approved and contested the fact that deputies on an official mission abroad had participated in the vote.
The basic text of the PEC was approved in the first round last week and the analysis of the text in the second round is scheduled for this Tuesday (9).
This proposal is of great interest to the government and allows for the expansion of public spending and makes possible the expansion of the Brazil Aid promised by President Jair Bolsonaro in an election year.
Rosa Weber stated that, in an initial analysis, she concluded that the questions deal only with issues related to the internal regulations of the Chamber of Deputies and do not represent any violation of the Constitution that would justify the intervention of the STF.
“The matter, at least in terms of summary cognition, appears to fall into the category of internal corporis act, a scenario that circumscribes the resolution of any interpretative controversy to the scope of that House,” he said.
The minister, however, did not rule out a decision being taken in the opposite direction after the approval of the PEC and mentioned that after the Chamber, the case must still be considered by the Senate.
“Moreover, I do not foresee, at least for now, the risk of ineffectiveness of any future concessional order, since, even if approved in the second round, by the plenary of the Chamber of Deputies, the Proposal for Amendment to the Constitution will not be immediately promulgated”.
In addition to this action, there is another judgment in progress at the STF that may have an impact on the vote on the topic in Congress. The ministers analyze until Wednesday (10) in the virtual plenary if they keep the decision of the minister Rosa Weber that suspended the payment of the rapporteur’s amendments.
There are already three other votes to maintain the court order prohibiting the execution of these values, which are widely used by the government as a bargaining chip on the eve of important votes. Before the approval of the PEC dos Precatórios last week, for example, R$ 1 billion was released in amendments of this nature.
