The INSS (Instituto Nacional do Seguro Social) will consider the original date of the expertise to pay the sick pay to those insured who cannot be attended during the experts’ strike, which started this Wednesday (30), according to the social security agency. .

In a note, the institute advises beneficiaries to reschedule their expert examinations, but informs that it will keep the original day of service as the date of entry of the application. This rule will not harm the insured at the time of payment of the benefit.

“Despite the rescheduling, the INSS will consider the date originally set as the date of entry of the application, to avoid financial loss to the insured”, says the body.

According to the institute, the new expertise can be scheduled through the My INSS app or website. In this case, you must have a password. It is also possible to schedule a new exam date by calling 135, which is open from Monday to Saturday, from 7 am to 10 pm.

According to social security legislation, the start date of payment of sickness benefit varies according to the type of insured. For workers with a formal contract, it starts counting from the 16th day of absence from work due to illness or accident.

In the case of individual insured persons, the benefit will count from the beginning of the incapacity, which must be attested by the INSS medical expert. However, according to the law, when the request is made by a worker away from the activity for more than 30 days, the sickness benefit will count from the date of entry of the request, that is, when he made the request to Social Security.

In general, when scheduling an examination, the insured should have a response within 45 days, but the average waiting time for the exam has been longer, according to lawyer Adriane Bramante, from the IBDP (Brazilian Institute of Social Security Law).

“There is an average wait of more or less 69 days. There are places where more is expected and others where it is much less”, she says.

For Adriane, the strike should further harm those who are sick. “While he is waiting, the worker does not receive any benefit and this compromises the family’s subsistence. There are people who scheduled the expertise for February 8 and were not attended, because of the first strike. They rescheduled for March and now they will have to mark again.”

Insured must attend the agency in order not to lose benefit

Adriane reinforces the guidance given previously to the insured: to go to the branch on the day and time scheduled and document the strike, if not attended to. “Go to the agency, take a picture, make sure you won’t be served. If you don’t go and, on the day, there are experts and all the other insured people are served, the worker loses the benefit”, she says.

The most worrying situations are in the extension expertise, which is when the insured had a scheduled discharge date, but is unable to return to work and asks to continue receiving assistance, and in the review expertise. If he misses any of these, he may lose the benefit.

Strike has no end date
