The CJF (Council of Federal Justice) released R$ 1.91 billion to pay arrears of social security and assistance actions, such as requests for review and granting of retirement, pensions and sickness benefits from the INSS (National Institute of Social Security). In the country, 122,413 beneficiaries will receive the money in this monthly batch of arrears, which includes 96,574 processes linked to social security benefits, such as retirement, or assistance, such as BPC (Continued Provision Benefit).
Once a month, Justice pays arrears of up to 60 minimum wages (corresponding to R$ 72,720, in 2022), which are called RPVs (Small Value Requests). To receive this lot, the payment order must have been given by the judge in March.
Retirees, pensioners and other INSS insured persons who win a judicial review or benefit granting process are entitled to arrears, which are the differences due while waiting for the action and in previous years. In the case of revisions, for example, the retiree is usually entitled to the differences that were not paid in the five years prior to the correction request.
Each court sets the exact date on which the money will be released for withdrawal, the CJF reported on Wednesday (20). In the case of the TRF-3 (Federal Regional Court of the 3rd Region), which serves São Paulo and Mato Grosso do Sul, the procedure for releasing funds for withdrawal usually takes, on average, seven days to complete. The TRF-3 received, in this lot, R$ 220 million to settle 7,591 processes of social security and assistance benefits, with 9,234 beneficiaries.
RPVs are released within two months after the process is fully completed. Payment of amounts is made through the federal court that serves the state of the beneficiaries.
To find out if he will have the money, the insured must check the release of the amounts on the TRF website to which he belongs. Consultation can also be made with the lawyer of the case, if any.
In all, the Federal Justice Council released R$ 2.4 billion for a total of 178,866 cases, with 214,503 beneficiaries. The total amount includes processes that are not related to social security and assistance benefits. The monthly batches of the CJF also include lawsuits by federal servants in search of salary differences and other funds, for example.
