Panel SA: Unions try to stop measure that released post to work without gas station

Gas station attendants reacted to the decision of the Federal Court that authorized a gas station company in Jaraguá do Sul (SC) to operate with self-service.

Fenepospetro (National Federation of Employees at Gas Stations and Petroleum Derivatives), which brings together more than 60 unions of the category in the country, decided to appeal in court, according to Eusébio Luis Pinto Neto, president of the entity.

“We understand that a federal judge is not competent to judge a law, which is a legislative matter, not a judicial matter. And the unconstitutionality of a national law, only the Federal Supreme Court”, he says.

This Tuesday (10) Neto went to visit gas stations in the network to talk to employees.

“Can not open [autosserviço] from one hour to the next. There would be mass unemployment in the country, because if you have a release here, other companies will come in as well. This will end up reaching the whole of Brazil”, he says.

Agricopel, owner of the Mime service station network, has 53 units in Santa Catarina with 1,200 employees, of which approximately 35% are gas station attendants, according to the company’s lawyer, Gustavo Pacher.

In the lawsuit against the Union, the company stated that it has difficulty hiring gas station attendants in the region. Pacher says that most professionals stay for a few months in the vacancy and then pursue other careers.

“The gas station network claims that there will be no unemployment, because they will absorb this workforce for other functions. They want to offer the consumer the opportunity of self-service and qualify the gas station attendants so that they can perform other activities”, says Pacher.

In his decision, Judge Joseano Maciel Cordeiro, of the 1st Federal Court of Jaraguá do Sul, understood that the law is incompatible with other legislation, such as economic freedom and technological innovation.

Fenepospetro’s appeal will be evaluated by the Federal Regional Court of the 4th Region, in Porto Alegre.
