Even announcing the interruption of his career, the influencer Iran Santana Alves, the Luva de Pedreiro, still has commitments to fulfill not only with the companies with which he has a contract, but also with the Justice. In the lawsuit brought by his former manager, Allan Jesus, it is necessary to make monthly deposits in court that reach the R$ 5.2 million termination fine for breaching the contract between the parties. The amount outstanding at the moment is R$ 5,122,869.02.

According to the rendering of accounts made to the Justice, Luva de Pedreiro received R$ 257.1 thousand in July and August. Therefore, it has already made two monthly transfers, corresponding to 30% of its total earnings. The first was R$
31,098.43, made at the beginning of August, referring to the amount that entered the account in July: R$ 103 thousand, sent by Allan himself, via ASJ Consultoria, as a result of contracts such as Amazon Prime.

The second deposit was BRL 46,032.55. This amount was the result of the percentage of the R$ 100 thousand that Falcão pays monthly to Luva de Pedreiro and another R$ 53,441.85 from the installment coming from Allan Jesus’ company.

In addition to Amazon, the partnership with ASJ earned Luva de Pedreiro a contract with Pepsi. After signing with the current managers —Falcão, former futsal player, Marcelo Seiroz and Mozyr Sampaio–, the influencer closed with Adidas in an 18-month contract and was already recording other commercials. Until the most recent rendering of accounts, the payment of the supplier of sports equipment had not materialized.

The money deposited in court does not immediately go to Allan Jesus. This will only happen if, in the judgment of the merits, the Justice gives the right to the entrepreneur in the process opened after the contractual breach by Luva. The bond between the parties was signed in February and was supposed to last four years. Four months later, Iran decided to change his career management, with Falcão’s company.

Iran’s lawyers tried to overturn the court’s order to transfer the 30%. If they had this request denied, they would at least want the percentage to be deducted only from contracts signed during the Allan Jesus administration. But yesterday (13) the influencer side had another defeat: the appeal was denied in the second instance. Thus, the collection in court is maintained, involving everything that falls into the Luva de Pedreiro account.

In the most recent decision, judge Gabriel de Oliveira Zefiro pointed out that the decision could only be changed – considering previous jurisprudence of the Court of Justice of Rio – if there was something contrary to the law or through evident evidence in the case file that led him to overturn the injunction .

When announcing yesterday that he would no longer make videos, Iran at least said that he would fulfill his contractual commitments already agreed. This would prevent the breach of contracts and ensure the receipt of the money already foreseen. But it can make new agreements unfeasible. Today’s businessmen see Luva in a moment of fatigue from overwork.

WHAT ABOUT MONETIZATION?

In the lawsuit, Luva de Pedreiro’s lawyers stated that Allan Jesus failed to transfer US$ 36,256.69 (R$ 188.1 thousand) related to the monetization of the YouTube channel. The businessman’s defense, in turn, claims that the money was not received right away because it was necessary to create a company and a CNPJ to issue invoices. According to Allan’s lawyers, the money from the monetization is being passed on to Iran along with the proceeds from the other contracts.

According to the agreement signed in February, Allan is entitled to 50% of the money for commercial agreements with Luva de Pedreiro. When breaking up with the previous businessman, the influencer claimed that he still lived in “precarious conditions” (referring to the house in Quijingue, in the interior of Bahia) and complained that Allan “had intense control of private aspects and access to social networks” .

In the lawsuit, Luva’s lawyers also allege that Iran is functionally illiterate, inexperienced in relation to the commercial and business aspects inherent to the influencer activity of the scale he has reached. Therefore, they try to disassociate themselves from the termination fine of R$ 5.2 million. At the first conciliation hearing, Allan Jesus asked for R$20 million to close the case. There was no agreement and the case is still pending in the Rio de Janeiro Courts.
