Justice maintains conviction of those responsible for racism against Maju Coutinho

The Justice of São Paulo unanimously upheld this Tuesday (18) the conviction of two men for acts of racism and racial slur against journalist Maju Coutinho, from Rede Globo. They were also convicted of misrepresentation and corruption of minors for have induced three teenagers to commit the same crime.

The men, using fake profiles on social networks, accessed the broadcaster’s page and uttered insults against the journalist, referring to her race and color. The appeal’s rapporteur, judge Augusto de Siqueira, said that the offenses reached an “undetermined number of people, not just the offended, so that they well configure the crime of racism”.

For Siqueira, it is undeniable that the defendants wanted to practice and incite discrimination with messages against a collectivity, based on race and skin color. “They were fully aware that the publications had objectionable content – ​​in fact, criminal –, with negative repercussions, enough to remove the Jornal Nacional page from the ‘air’, after being denounced”, said the magistrate.

The rapporteur accepted the defense’s appeal for the crime of criminal association in which the defendants were convicted in the 1st degree. He said that, despite the high number of people, it is not certain that they gathered to commit more than the crimes narrated or if they were stable and permanent.

One of the convicts must serve five years and three months of imprisonment and the other four years and six months, both in an initial semi-open regime.
