Special prosecutors are seeking to indict actor Alec Baldwin for the fatal shooting of cinematographer Halyna Hutchins on the set of the film “Rust” in 2021presenting new evidence to the jury.

Prosecutors Kari Morrissey and Jason Lewis, based in New Mexico, said they will present their case to a jury within the next two months, noting that “new evidence” has come to light. Baldwin, 65, was pointing a .45 Colt pistol at the filmmaker during filming on Oct. 21, 2021, when the gun went off, killing her and injuring director Joel Souza.

Additional evidence has come to light that we believe shows the famous actor is criminally responsible for the death of Halyna Hutchins and the shooting of Joel Souza“, prosecutors said.

We believe the proper course of action is to allow a New Mexico Citizens Commission to decide from now on whether Mr. Baldwin should be remanded in custody after reviewing the new evidence».

In January, he was charged with two counts of negligent homicide in connection with the death of Halyna Hutchins and the injury of Souza. The actor was accused of showing “reckless” disregard for safety on the set of the film.

Baldwin stated that the gun went off accidentally. He has repeatedly said he was told by crew members that the gun was not loaded and has also insisted he did not pull the trigger. In February, Baldwin pleaded not guilty to manslaughter and had agreed to court terms to finish shooting the low-budget film, as well as to be prohibited from using weapons and drinking alcohol.

The recent analysis of the gun by experts based in Arizona and New Mexico relied on parts to reassemble the gun Baldwin fired after parts of the gun had broken off during earlier tests by the FBI. The report examined the weapon and the marks it left on a spent cartridge to conclude that the trigger must have been pulled or pressed.

An FBI report on the agency’s analysis of the gun found that, as is common with firearms of this design, it could have fired without the trigger being pulled. The retrial for the actor will be held behind closed doors amid heightened concerns about gun safety in New Mexico.

Rust Movie Productions has paid a $100,000 fine to state workplace safety regulators. Filming on “Rust” resumed this year in Montana under an agreement with the husband of the late filmmaker Halyna Hutchins, who served as an executive producer.

The incident has caused Baldwin – a three-time Emmy winner and one-time Oscar nominee – to stop accepting job offers. His acting has been limited to independent productions, financed by the other producers of “Rust”, along with a few animated films. During this time, he has also participated in podcasts.

In October, Baldwin entered into a confidential settlement with Matthew Hutchins, the filmmaker’s widower. According to this agreement, the team must continue filming in 2023 and the profits from the box office will go to the husband of the deceased.
