Zagallo leaves inheritance to only one of his children and reveals ‘deep disappointment’ in will

Died on January 5, Mário Lobo Zagallo left his inheritance to only one of his four children, the youngest Mario Cesar, and his daughter-in-law, Mirella. O F5 had access to a will drawn up by the football idol in 2016.

In the will, the notary states that “the testator wishes as his last wish to leave the entire available part of his assets to his youngest son, Mario Cesar de Castro Zagallo, and that the choice was made ‘due to the deep disappointment with his three other children ‘.”

According to Zagallo’s own account in the document, his other three children, Paulo Jorge, Maria Emília and Maria Cristina, abandoned him when he was widowed.

Zagallo was widowed in 2012, after losing his wife, Alcina de Castro, to respiratory failure. All four children are hers. The idol stated in his will that only the youngest gave him “affection and attention” while the other three “managed judicial and extrajudicial procedures” to annul his mother’s inventory.

In the will, Zagallo also says that the lawsuit brought against him by his own children caused him the “deepest sadness and hurt”.

Legal fight

At the time of Alcina’s death, the Court determined Zagallo as the woman’s universal heir, according to the will left by her. One of the properties that was part of the estate was sold and Zagallo donated R$500,000 to each child.

Dissatisfied with the amount, the three eldest children renounced their shares in the so-called “hereditary share” and filed an appeal asking for the annulment of their mother’s inventory. In the process, the trio alleged that Zagallo omitted the existence of the woman’s will, which has not been proven.

In 2020, the appeal was denied in a ruling by the 18th Civil Chamber of the Court of Justice of Rio de Janeiro. In the document, obtained by F5, the TJRJ declares the process extinct, maintaining Zagallo as universal heir. Alcina’s will contained an inalienability, incommunicability and unseizability clause, which means that the children would only have access to the remainder of their mother’s estate after their father’s death.

Children will still receive a mandatory percentage

The will left by Zagallo concerns only half of the estate. Each child will still receive their obligatory share of the other half of the inheritance. The other 50% will go to the youngest child, as per the father’s request. Thus, Mario Cesar will have 62.5% of the assets, while his brothers will have only 12.5%.
