Gloria Pires will be compensated at $ 15,000 per reproduction of meme ‘I can’t give their opinion’

Almost ten years ago, Gloria Pires viralized when she was invited to comment on the Oscar live. At the time, the actress said “not being able to give her opinion” about some of the productions that competed in the awards.

Because of the meme, now she will be compensated at $ 15,000 as a result of a website that used her image and phrase at the time to sell preparatory courses.

The Rio Justice determined that Cesar Augusto Marques, owner of Me Passa Ai Editions, Productions and Empreendimentos Ltda improperly explored the image of the actress without consent.

In the process, magistrate Maria Inês da Penha Gaspar of the 5th Chamber of Private Law uses a screen capture from one of the page posts to exemplify the contents of the online domain.

“The conduct of the defendants to expose, without permission, the image of the plaintiff, on her Facebook social network, violated her moral assets, notably the rights of personality concerning the image and privacy, and her civil liability is characterized.”

In the image, “pass me” asks “what did you think of the calculation class?” and left the alternative answers: “I am not able to give their opinion; cool; very interesting; I did not watch,” phrases also said by Gloria during the transmission.

The judge did not uphold the artist’s request for material damage and argued that the actress did not say how much she charges for using her image and what she would have ceased to earn as a result of broadcasting on the site.

“It is noteworthy that the use by the defendants has not led to associate their image and/or endorsement with the product they offered, but only draw the attention of their so-called consumers.”
