The Secretary of Justice and Citizenship, Fernando José da Costa, confirmed the application of the first fine in the administrative scope for a person who cut the line for the vaccine against Covid-19 in the state of São Paulo. The decision was published in this Thursday’s edition of the Official Gazette (2).
A resident of Guarulhos, in Greater São Paulo, the woman, who is a veterinarian, circumvented the city’s health system by taking the third dose of the immunizer when the vaccine booster was not yet recommended by Organs responsible bodies.
Costa’s decision obliges the veterinarian to pay a fine of R$ 27,174.50. The penalty had been imposed by the Special Integrated Vaccination Commission, the nucleus responsible for investigating the case and which had already recorded the same amount as punishment. The woman even filed an appeal, which depended on the secretary’s assessment.
The report was unable to locate the veterinarian.
The case became known when the woman published, on a social network, that she would have received two doses of Coronavac in February and March 2021 and one dose of Janssen, in June. The reinforcement began to be applied by the government months later, in September.
In her social networks, the veterinarian said that she did not trust the immunizers. She later deleted that post after the backlash of the case.
After analyzing the appeal, Fernando José da Costa understood that the woman had no regrets or justification for passing in front of other people who were priorities in the vaccination line at the time. “Her attitude was a disrespect for life in society and, thanks to the denunciations in the press, it was possible to investigate the case and apply the appropriate administrative punishment.”
According to the Secretary of Justice and Citizenship, until May of this year, the Integrated Special Commission received 134 reports of cases of people who took the vaccine against Covid-19 outside the calendar, 24 of which were revaccination cases. Of the total, 91 procedures were initiated.
The commission includes representatives of the Department of Justice and Citizenship, the General Administration Office, the State Department of Health, the areas of Sanitary and Epidemiological Surveillance and the Department of Regional Development.
In addition to the administrative fine, in January, she was sentenced in court, in the first instance, to pay R$ 50 thousand to the municipality of Guarulhos for moral damages, for the same reason.
According to Judge Rafael Tocantins Maltez, from the 2nd Court of the Public Treasury of Guarulhos, the veterinarian, by disclosing how she circumvented the system, showed that she was aware of the illegality of her attitude.
“He made fun of it on social media, bragging about his unethical attitude, with visible derision and spreading disinformation,” the judge wrote in his December 2021 decision. He defined the facts as uncontroversial.
To Justice, the woman explained that, when she was vaccinated in Guarulhos, she was not asked by health agents if she had already been immunized and that on the day the system was inoperative, which shows that she did not act intentionally or premeditatedly. She also said that she suffered massive attacks after the repercussions of the case.
