Court condemns veterinarian who took 3 doses of Covid vaccine

The Justice sentenced a woman to pay R$ 50 thousand to the municipality of Guarulhos, in Greater São Paulo, for moral damages, after she circumvented the city’s health system and took the third dose of the immunizer against Covid-19, when the booster vaccine was not yet recommended by Organs responsible bodies.

The decision of the 2nd Court of the Public Treasury of Guarulhos was taken last month and can be appealed against.

The case became known when veterinarian Jussara Barreira Sonner stated, on social media, that she would have received two doses of Coronavac in February and March 2021 and one dose of Janssen, in June. The reinforcement began to be applied by the government months later, in September.

In her social networks, the veterinarian said that she did not trust the immunizers. “I know that no vaccine is completely safe, as there was no time to carry out the tests! But as I took the vachina at the beginning of the year, I was very uncomfortable with it! I waited as long as necessary —3 months— and today I managed to take the Janssen one ! Now I feel more protected, it’s a single dose and I’m free to travel.” She deleted the post after the repercussion of the case.

Sonner told Justice that, when she was vaccinated in Guarulhos, she was not asked by health agents if she had already been immunized and that on the day the system was inoperative, which shows that she did not act intentionally or premeditatedly. She also said that she suffered massive attacks after the repercussion of the case.

According to Judge Rafael Tocantins Maltez, of the 2nd Court of the Public Treasury of Guarulhos, the veterinarian, by disclosing how she circumvented the system, showed that she was aware of the illegality of her attitude.

“[Sonner] He mocked on social media, boasting of his unethical attitude, with visible derision and the spread of disinformation,” the judge wrote in his December 2021 decision. He defined the facts as uncontroversial.

For Maltez, if everyone took the booster dose on their own, before the recommendation of Organs competent bodies, public vaccination policy could be compromised.

“We live in a society, which brings obligations to be observed by the community for its own survival and development, and individualized decisions cannot be taken to the detriment of the social body.”

A leaf has not been able to contact Sonner or his defense as of the publication of this text.

Recent studies point out that the booster dose increases the person’s protection against Covid. A survey by the Hospital das Clínicas in São Paulo showed that after the third dose the production of antibodies rises to 99.7%, very close to the total.

In order to increase protection against the ômicron variant, the Minister of Health, Marcelo Queiroga, announced in December the reduction of the booster dose application interval from five to four months.

The demand for the booster dose soared in January in Brazil, amid the increase in cases of the disease driven by the ômicron variant. Even with a data blackout since December, the daily number of vaccines applied in the country is the highest since the beginning of this phase of the campaign.
