The Minister of the Federal Supreme Court (STF) Ricardo Lewandowski officiated, this Wednesday (19), to the Public Prosecutor’s Offices of all states and the Federal District to urgently adopt measures to inspect parents who are not vaccinating their children against Covid. .
The Rede Sustentabilidade party called the STF on Tuesday (18) asking for recognition of the power of Guardianship Councils in overseeing the vaccination of children and adolescents and also the duty of schools to denounce these situations.
In the letter, Lewandowski says that the Public Ministry must ensure that the necessary measures to supervise the vaccination of children are being adopted as provided for in the ECA (Statute of Children and Adolescents) and the Federal Constitution.
Legislation and other recent STF decisions already determined that parents do not have the right to refuse to vaccinate their children.
Despite the legal provision, only five states in the country had determined that their schools are obliged to demand proof of vaccination from students, as shown by the leaf. The others claimed not to be able to request the document.
The Sustainability Network’s request came after the Ministry of Health stated that vaccination for children aged 5 to 11 is not mandatory in the country. The party claimed that the ministry’s guidance directly violates the fundamental precepts of the Constitution that protect children, “including the irresponsible conduct of those responsible, when they choose not to vaccinate them.”
Both the Federal Constitution and the ECA ensure that vaccination, which includes immunization against Covid, are the rights of children and adolescents and a duty of parents and society. Therefore, not only are parents required to vaccinate their children, but schools, guardianship councils and other bodies are responsible for monitoring compliance with immunization in minors.
The ECA provides for mandatory vaccination of children and adolescents in cases recommended by health authorities, which applies to the Covid vaccine. In December, Anvisa approved the use of Pfizer’s immunizing agent for the 5 to 11-year-old range and recommended the application, as studies have indicated an effectiveness of 90% in this audience.
The attempts by President Jair Bolsonaro (PL) to question the safety of vaccination in children gave rise to a minority of the population to question the right of parents not to immunize their children.
Datafolha research showed that vaccination against Covid for children is supported by 79% of the Brazilian population aged 16 and over. Those who reject it are 17%, and those who did not know how to give an opinion add up to 4%.
