All changes in the mandatory rapid tests for employees in the private sector are clarified in an announcement issued by the Ministry of Labor.

The announcement:

The Ministry of Labor and Social Affairs informs that from Monday, February 7, 2022, changes are made in the framework of the mandatory diagnostic tests for the employees of the private sector, following the regulation provided in the Joint Ministerial Decision 4761 / 28-1-2022 (Government Gazette B ΄ 290), according to which “As of February 7, 2022, fully vaccinated are considered those adults who have been vaccinated and a period of at least seven (7) months has elapsed from the administration of the second dose or, in the case of single-dose vaccines, three (3) months from the administration of the single dose, if they have also received the booster dose of the coronavirus vaccine “.

Therefore, from 7.2.2022 those private sector employees who provide their work with a physical presence in the workplace have been vaccinated, but after a period of up to seven (7) months from the administration of the second dose or, in the case of single-dose vaccines , up to three (3) months from the administration of the single dose, have not received the booster dose, have the obligation to undergo a diagnostic test according to the provisions of number 64232 / 15.10.2021 (Government Gazette B ‘4766) JMC, as amended by the number 69459 / 5.11.2021 (Government Gazette B ‘5165) JMC.

In other words, they are obliged to carry out an inspection twice a week at their own expense, under the same conditions that apply to unvaccinated workers. The obligation is lifted immediately from the day of the reminder.

Employees who have been diagnosed with coronavirus are not required to undergo rapid tests and prove it by presenting a Certificate of Disease. The Certificate of Disease is issued: a) after laboratory testing by PCR for coronavirus COVID-19, within fourteen (14) days after the first positive test, b) especially for fully vaccinated, after a positive test using rapid test. The validity of the disease certificate lasts up to ninety (90) days after the positive test.

Regarding the control of compliance with the obligation to perform a rapid test, it is reminded that diagnostic centers, private clinics, etc. send within 24 hours to the National Register of Patients COVID-19 kept in IDIKA the data of the persons tested and the result of the test (positive or negative).

If the result of the control is negative, after this registration the employee can issue a Certificate of Negative result from gov.gr.

If the result is positive, the employee immediately informs the employer, is placed under house arrest, the protocol of EODY is followed and the regulations of article 62 of law 4886/2022 and the implementing YA 6924 / 27.1.2022 (Government Gazette B) are applied. ‘291) for the special leave due to an employee’s illness from coronavirus.

The Responsible Declaration mentioned above is submitted for the first two weeks, ie from February 7, 2022 (date of entry into force of the new arrangements for the booster dose) until February 20, 2022, the period from 22 to 25 February 2022. Then it will be submitted every week from Tuesday to Friday for the previous reporting week.
