Sailing coach’s trial: Sentenced to 13 years in prison for child abuse in incest

The court unanimously rejected the recognition of mitigating circumstances in the convict.

13 years imprisonment imposed by the Mixed Jury Court on the 39-year-old sailing coach who found guilty of the offense of child abuse in indecency against an athlete ten years ago.

The accused will return to prison, as the court, with a similar prosecutorial proposal, denied the administration of an inhibitory effect on appeal.

A little earlier the judges unanimously rejected the 39-year-old’s request for recognition of palliativesrejecting the prosecutor’s proposal that suggested the recognition of the mitigation of good behavior after the act, judging that the coach has evidence from which a positive change of character emerges.

According to the prosecutor, the court should not recognize the coach nor the alleviator of sincere repentancenor of the previous legal life, as requested by the convict.

As he stated: “The accused maintained contact with an 11-year-old child for a few months”, something that the Prosecutor stressed that constitutes “a deviation from the normality of social relations and constitutes criminal behavior” and therefore there is no question of legal life “.

Respectively for the sincere repentance, the Prosecutor pointed out that “the confession for the act of abuse of a minor is not enough to substantiate the specific mitigation”.
