Dodecanese: A 47-year-old man is on trial for neglecting a minor for pay

In the fall, he was scheduled to be tried by the Single-member Court of Criminal Appeals Dodecanese the case of a 47-year-old accused of negligence against a minor for pay and also of violating the drug law, reports the rodiaki.gr.

It is about the complaint made six years ago by the -then- 17 year old high school studentto the police of the island of Dodecanese where he lived with his grandmother and who had declared to the police that a month earlier on different dates, the 47-year-old had allegedly asked him to perform lewd acts on him, while he had also given him cigarettes with raw cannabis.

In the same case, a 58-year-old man is charged as the person who supplied the 47-year-old with the cigarettes with the narcotic substance.

According to information, in the statement given by the -then- minor, he had stated that everything started a month before the complaint (November 2016), when one night he had gone out for a drink at a store on the island.

At about a quarter to midnight and having consumed some drinks, the 17-year-old said he went to the 47-year-old’s shop to get “papers” for the rolling cigarette he was smoking. There, the accused allegedly asked him if he had smoked hashish and when the minor answered in the negative, the 47-year-old allegedly asked him “if he wanted to do it.”

The 17-year-old had said that, as he was under the influence of alcohol, he responded positively and then the 47-year-old asked him to give him oral sex first, as he did and then gave him a cigarette which they smoked together. The minor also complained that two days later he went to the 47-year-old’s store again to buy some things and asked him if he had hashish.

The 47-year-old at first replied that he didn’t have any, but before he left, the minor told him to wait for him outside the store because he had some. And that time, the 17-year-old complains, that the indiscretion against him was preceded in the same way as the first time and then they smoked the cigarette with the hashish.

He even mentions in his testimony that the second time he told the 47-year-old that he did not want this to continue and that if he wanted to smoke again in the future he would pay him and the defendant told him that he did not want money.

Following the complaint, a case file was filed against the 47-year-old and criminal charges were brought against him for indecency committed by an adult to a minor in return for financial consideration, following and trafficking in narcotic substances in the most specific forms of supply, possession and disposal by non-addicted perpetrators , while from the preliminary investigation that was carried out it emerged that the 58-year-old had given the drugs to the defendant, with the result that he was also referred to justice.

Reverse the charge

However, according to information, apologizing to the investigator Rhodes accompanied by his lawyer Mr. Akis Dimitriadis, the 47-year-old had reversed the claims of the minor and had stated that the young man was the one who gave him to smoke cigarettes and also asked him to do the wicked deeds!

More specifically, the 47-year-old had said that he and the young man met in November 2016 in a bar on the island where he lives, when he approached him and they talked. In fact, the young man told him that he was 18 years old and that he liked men and wanted them to get to know each other better.

The next day the young man went to his shop at closing time – the 47-year-old claimed – they sat down, had a drink together and then the young man asked him if he had used hashish. The 47-year-old, who was an occasional user, answered in the affirmative and then the young man took a small amount of tobacco out of his pocket, told him it was hashish and asked him if he wanted to smoke it together.

That’s how it happened and after they consumed another drink, the 47-year-old said that the young man asked him if he wanted to give him oral sex. The defendant claimed that he accepted because of the alcohol and drugs and after the act was over, the young man told him that he had a good time and would visit him again, while he asked him next time to have a cigarette for them to smoke.

Indeed, two days later the young man went to the 47-year-old’s shop again and the same thing happened, while he asked the defendant to continue their relationship, which he refused. The 47-year-old had said in his apology that since then the young man did not bother him again and that a month later the police went to his shop and arrested him.

The 47-year-old had also added that apparently the young man was forced to make the complaint after pressure from his relatives and had emphasized that he has never been concerned about the slightest thing but also the fact that when the police visited him he voluntarily gave the quantity of raw cannabis he possessed.

He also added that when he went to the police station, the police officer told him that he had written everything he needed in his statement so that he would not have a problem and he signed it without reading it, which happened shortly before his apology, finding that he had never said everything that is stated there (pre-investigation) and that the truth is what he said before the investigator: that is, that he never asked the complainant to do anything in return.

Finally, after the completion of the procedure with the consent of the competent prosecutor, the 47-year-old was released with the restrictive condition of appearing once a month at the police station of his area.

The trial was set for September 19, 2022.
