Extension for credit notes of tourism businesses to their customers

In the explanatory statement of the draft law submitted to Parliament by the Ministry of Development and Investments, it is noted that “tourist businesses continue to present sustainability issues due to the negative economic impact of the COVID-19 pandemic”.

Extension until December 31 is given for the credit notes granted by tourism businesses to their clients and concerning contracts terminated during the period from February 25, 2020 to September 30, 2020.

Specifically, in the explanatory statement of the draft law submitted to Parliament by the Ministry of Development and Investments, it is noted that “tourist businesses continue to present sustainability issues due to the negative economic impact of the COVID-19 pandemic”.

Specifically, the provision states the following:

Article 10

By way of exception, regulations on the termination of contracts between tourism businesses and their customers for the provision of tourist services – Amendment of par. 3 of article seven of the Act of Legislative Content from 13.4.2020

In par. 3 of the seventh article of the Act of Legislative Content from 13.4.2020 (A’ 84), which was ratified by article 1 of Law 4690/2020 (A’ 104), the second paragraph is amended, regarding the expiration dates of the validity of the credit notes, and par. 3 is formulated as follows:

“3. If, following the complaint referred to in paragraph 1, the tourist company is obliged to return to the customer any amount that the customer has paid as an advance, guarantee, engagement, partial or full payment or in any other form for the execution of the contract, the tourist company company may, in derogation of the applicable provisions of the contract or law, offer the customer instead of a refund an equivalent credit note valid for eighteen (18) months from the date of its issuance. The credit notes of par. 2, whose validity has expired or will expire until 30.6.2022, are extended from their expiration until 31.12.2022”.
