RAE: Final letter to three energy suppliers for review of misleading practices

Companies have until Monday 8 August 2022 at 11am to comply.

Strict warning in at least three electricity suppliers that apply deceptive tactics issued by the Energy Regulatory Authority, requesting compliance of their advertising strategy with the requirements of transparency, clarity and avoidance of misleading impressions by Monday, August 8, 2022 at 11:00 a.m., due to incidents of abusive practices in advertisements for discounts.

In announcement in fact, it states that “on Tuesday, August 9, 2022 at 11:00 a.m., RAE will post on its website the details of the suppliers who did not withdraw – duly revised their commercial policy. Similarly, the details of the suppliers who may fail to notify in a timely manner how they comply with their above obligations will be posted.”

The Energy Regulatory Authority, following its announcement from 1.8.2022 regarding apparent abusive practices of Electricity Suppliers, which may mislead consumers in relation to the subsidy provided by the State through the Energy Transition Fund (TEM), concludes the control over the advertising listings in printed, radio and television media, websites, as well as social media, of the supply invoices formulated in accordance with the provisions of article 138 of Law 4951/2022, as applicable.

The control in question was carried out on the basis of the data sent by the Suppliers as well as data collected by RAE on its own initiative. It is noted that not only the entries of the Suppliers in all the information and communication media, but also of their commercial partners were checked. Obviously, the examination in question required the diligent effort of the Authority, taking into account the volume of data, the short time frame and the incomplete response of some Suppliers to the obligation of their timely submission.

As can be seen, following the Authority’s Notice, the Suppliers have taken steps to ensure that their advertising strategy complies with the requirements of transparency, clarity and avoiding misleading impressions. However, in at least three cases of Suppliers, it appears that the marketing communication of their products is further scrutinized in light of misleading consumers and unfair competition, in breach of the framework text. To the said Suppliers, the Authority today addressed a letter, in which they pointed out the specific problematic cases of advertisements and ordered a strict deadline for the submission, by Monday, August 8, 2022 at 11:00, of the duly reformed entries, based on directions to be sent within the day to all Suppliers.

On Tuesday, August 9, 2022, at 11:00, RAE will post on its website the details of the Suppliers who did not withdraw – they correctly revised their commercial policy. Likewise, the details of the Suppliers who may fail to notify in a timely manner how they comply with the above obligations will be posted.
