The secondment of EL.AS executives in the Permanent Body of the European Border Guard, the election of trade union bodies of police officers with a single ballot, and the introduction of differentiation between male and female candidates for recruitment in the schools of the Greek Police, (height at least 1.70m for men and 1.63m for women) are included in an amendment of the Ministry of Civil Protection, which was tabled in the bill of the Ministry of Interior for the Protection of Volunteerism. The bill will be introduced, for discussion and voting, by the plenary session of the Parliament, next Monday, 13/12/2021.
According to the GLC report, this amendment:
1. The possibility of granting, by etc., compensation, according to article 21 of law 4354/2015, is provided to the staff that participates in the committees of conducting health examinations and sports and psychotechnical tests of the Ministry of Citizen Protection (article 11 of law 4760/20120).
2. The secondment of Greek Police officers to the Permanent Corps of the European Border and Coast Guard is foreseen through:
a. long-term secondments, by payment of compensation directly from the European Border and Coast Guard Organization, without being entitled to a difference in foreign service allowance as well as any other travel expenses of law 4336/2015,
b. short-term shipments and through the Rapid Reaction Reserve, with payment of compensation including the costs of renting a vehicle, which are paid by the institution, if they can not be paid directly by the above Agency and reimbursed by him as the extraordinary income. For the said amounts of compensation and expenses, which are subject to deductions in accordance with the provisions of law 4336/2015, it is provided, retroactively from 27.1.2021, that:
– are recognized on the basis of the submitted documents and limits set by the European Border and Coast Guard Agency, and in case of establishment of unit costs by that Agency, the respective compensation or expense is equal to the unit costs, regardless of the amount spent by ,
– The amount paid to the transferor may not exceed the amount reimbursed by the Agency as extraordinary revenue to the regular budget.
3. The following is foreseen: i) the possibility of training the personnel of Category 1 of the European Border and Coast Guard (Frontex) developed in the Greek territory, by officers of the Hellenic Police regarding the occupied equipment, ammunition and other equipment and ii) the regulation , by ministerial decision, of more specific issues related to the training of this staff.
4. Arrangements are included regarding the settlement, liquidation, warrant and payment of expenses of the Ministry of Citizen Protection and the General Secretariat for Anti-Crime Policy of the same Ministry. In particular, they are considered legal and normal, by way of derogation from any general or special provision, and can be withdrawn, cleared and paid for:
a. until 31.12.2021, to the detriment of the relevant appropriations of the current financial year, expenses of the Special Bodies of the Ministry of Citizen Protection, managed by the Greek Police, which took place until the publication of the law under adoption, even to the detriment of the relevant Fixed Assets Advance payment. In cases of urgent and unforeseen needs, the request for the issuance of decisions on the travel expenses of the moving police personnel as well as the issuance of these decisions may be made at a later time,
b. to the detriment of the appropriations of the Special Bodies managed by the Hellenic Police, additional travel expenses due to inability to return on the due date of the uniformed personnel of the Hellenic Police to the headquarters of its Service, due to force majeure events and for how long it lasts,
c. to the detriment of the budget appropriations of the General Secretariat for Anti-Crime Policy for the current financial year and for the financial year 2022 provided in the years 2016, 2017, 2018, 2019 and 2020. The above costs can be covered only by the Ministry of Finance with an extraordinary increase in appropriations of the budget of the General Secretariat for Crime Policy,
d. to the detriment of the budget of the General Secretariat for Anti-Crime Policy, provided that they are covered by the approved appropriations of the budgets of the respective years, its expenditures incurred and related to services provided from 1.1.2020 to 31.12.2021, after the expiration of the mentioned contract for the pilot implementation of the institution of electronic surveillance of convicts, convicts and detainees on leave.
5. The obligation of the Welfare Fund for Employees in the Security Forces (TAPASA) is established, in derogation of the provisions (article 30 of law 4996/1974), to prepare and submit by December 31, 2021 the outstanding balance sheets of all sectors, Sectors and the Special Account of law 826/1978 of Τ.Π.ΑΣ. / ΤΑ.Π.Α.Σ.Α. for the years up to 2018 and no later than 31 December 2022 for the years 2019, 2020 and 2021. From 2022 and for each subsequent year, the balance sheets shall be submitted no later than 30 June of the following year of each fiscal year, in particular defined.
6. Issues related to the exercise of trade union rights of incumbent police officers of all ranks of the Greek Police are regulated (article 30A of law 1264/1982) and in particular:
a. It is stipulated that the election of the bodies and the representatives of the trade unions of the above employees is made by a single ballot paper, in which all the candidates are included.
b. The procedure for conducting the voting and election of candidates is defined.
c. Transitional provisions are introduced according to which the above-mentioned organizations are obliged to adapt their statutes in accordance with the proposed provisions, within the set deadline.
7. A distinction is introduced between male and female candidates for recruitment in the Greek Police schools, in terms of the minimum required height, which is at least one meter and seventy centimeters (1.70 m) for men and one meter and sixty-three centimeters (1.63 m.) For women.
8. Issues of transfer / transfer of the personnel serving in the mentioned services of the National Intelligence Service (EYP) to Central or Regional Services of the Hellenic Police are regulated, in derogation of the textual provisions.
In particular, inter alia, it is provided that:
– the transfer is carried out with the same employment relationship in recommended permanent posts of civil servants, which are abolished in any way by the departure of officials,
– the transferred staff is paid by the Hellenic Police and maintains any difference in relation to the monthly salaries of the service of origin as a personal difference (article 27 of law 4354/201),
– the required credits for the total payroll of the transferred / transferred staff for the years 2021 and 2022 are transferred by the E.Y.P. to the Greek Police.
