“Rain” the fines at fuel stations for not informing fuelprices.gr

Violators shall be fined 3,000 euros for not submitting a declaration, for submitting a false or inaccurate declaration or for not submitting a new declaration of retail prices of fuel products on the website www.fuelprices.gr.

“Rain” the fines fall to gas stationsrecently, by the Interagency Market Control Unit (DIMEA) because they do not update the website www.fuelprices.gr of the Ministry of Development and Investments, as they are obliged to do, regarding the changes in the prices of liquid fuels, heating oil, natural gas and LPG.

As the commander of DIMEA told APE-MBE Charalambos Melissinosinspections at gas stations, fuel companies and refineries “is an area that is, until today, our immediate priority”.

Mr. Melissinos points out that the law maintains the obligation to inform, but it is found that some gas station owners are neglecting it, with the result that more than ten fines have been imposed recently.

However, the gas station owners, for their part, are protesting. The Panhellenic Federation of Fuel Dealers (POPEK) in a recent announcement she complains because, as she notes, “decisions with relevant fines are issued by the Ministries, in case of non-adjustment, without even asking the opinion of the industry, nor even informing the industry of their issuance, such as decision 106242/2022 Official Gazette B5702, concerning a new obligation to renew the declaration of the retail price of fuel within 7 days, with relevant fines.

It is recalled that a new decision of the Ministry of Development and Investments (106242/4.11.2022) changed the rules regarding the notification of retail sales prices of liquid fuels, LPG, heating oil and compressed natural gas.

Specifically, the decision foresees the addition of article 114 to the no. 91354/24.08.2017 decision of the Minister of Development and Competitiveness “Codification of Rules for Circulation and Trading of Products and Provision of Services (Rules of DIEPPY)”, regarding the disclosure of retail selling prices of liquid fuels, LPG (AUTOGAS), heating oil and compressed natural gas (CNG), which is structured as follows:

Article 114

Notification of retail sale prices of liquid fuels, LPG (AUTOGAS), heating oil and compressed natural gas (CNG)

Holders of a license to operate a liquid fuel station, to sell gas exclusively for the movement of AUTOGAS vehicles) through pumps, to sell heating oil (for home deliveries) and to operate a compressed natural gas (CNG) station, are required to declare on the website www.fuelprices. gr of the Directorate of Data Management, Statistics and E-Commerce Supervision of DIMEA, of the Ministry of Development and Investments, the retail price per unit of measurement for each of the products they have under their license.

Especially for the home sales of heating oil, the holders of licenses to operate liquid fuel stations and sellers of heating oil are required to disclose, separately, the retail prices for oil deliveries:

a) up to 499 liters,

b) for deliveries from 500 to 999 liters,

c) for deliveries of 1,000 liters or more.

The obligees must declare the retail price per unit of measurement for each of the products they have, based on their license, on the website www.fuelprices.gr without delay every time it changes.

In the event that the retail price does not change, the obligees must submit a new declaration with the same price within seven days of the last declaration and the obligees declare the retail price per unit of measurement for each of the products they have, based on the license them, on the website www.fuelprices.gr exclusively via the internet.

If the debtor does not have access to the website www.fuelprices.gr, he is not allowed to change the retail prices at which he offers his products to the consumer until he gains access to the website and declares new sales prices.

Violators shall be fined 3,000 euros for not submitting a declaration, for submitting a false or inaccurate declaration or for not submitting a new declaration of retail prices of fuel products on the website www.fuelprices.gr.
