A 40-year-old man was sentenced to 15 years and 8 months in prison by the Court of Appeal, who killed his 43-year-old neighbor with a hunting rifle and injured his wife, due to the loudness of the music.
The murder was committed in September 2018, in the Roma settlement, in Diavata Heights, in Thessaloniki. The perpetrator’s hand allegedly “weaponized” a remark he received from the victim, three 24 hours earlier, because he was playing loud music from his home speakers and could be heard up to his house, a hundred meters away.
As described in the indictment, the 40-year-old broke the window of the house, initially shooting towards the victim’s wife, but without hitting her, since she managed to take cover behind the sofa. The victim responded to the initial shots, wounding the accused in the abdomen with a pistol. New shots were fired by the defendant, resulting in the fatal wounding of his 43-year-old neighbor.
“I didn’t intend to kill him, I was defending myself,” said the defendant, among other things, claiming that he had consumed alcohol, while apologizing to the victim’s family.
At first instance, the 40-year-old was sentenced to 25 years in prison, with the recognition of the mitigating factor, that he was led to the act due to the inappropriate behavior of the victim. After the reconviction, he returned to prison to serve the remainder of his sentence.
