The testimony of the 14-year-old, who reported the 47-year-old boxing coach for sexual harassment, is shocking.
The judges also took seriously the report of the child psychiatrist and so with 2 votes against 1 (the president of the Court of First Instance asked that the coach not be remanded in custody) decided to remand him in custody.
“All over her body but mainly from the waist down and more and more time, but I did not tell him anything because I did not know what to do at that time” noting that “he was touching her in all areas of her body”, said the 14-year-old in her deposition.
Asked by the pre-investigation officer whether the touches in question were part of the training, she categorically answered in the negative, explaining that “he was touching her below the waist and it was more intense”.
Asked about this, the minor states that “initially he caressed her everywhere and then pressed her with his hand, aiming over the clothes on the genitals and the anal area even more intensely, while at some point he tried to remove her blouse. At the same time, he was touching her all over her body in the genitals and in the anal area and his body was stuck on her, he said that she has a very nice body “.
The minor in her testimony points out that “during the whole time he was treating her, his body was stuck on her, while she could not see his face because he was behind her and he was touching her”.
Asked how long it took her, she said it lasted about half an hour. In fact, he stated that “every time someone came to the place or the women who did gymnastics went up and down, he would move away from it and then after the departure of which third parties he would approach it again”. The above happened about three or four times.
The 14-year-old, terrified by this incident, did not know how to react, pretended that she did not understand exactly what was happening and waited until the end of the lesson to leave.
The 14-year-old then left and while she was on her way she started crying and called her peer friend mentioning the incident. He urged her to calm down and talk to her mother, although she feared that once her mother was informed of the incident she would not allow her to continue the sport of boxing. But her boyfriend pointed out that if she did not report it to her mother, he would inform her.
The student then telephoned her mother, who realized that her daughter was not well, took her for a ride in her car, where she cried and told her mother that she wanted to change gym and told her exactly what had happened during duration of training.
The 14-year-old, at the end of her testimony, expressed her fears that the accused, who saw her outside the Police Station and showed her to others from the school, may have harmed her, while also expressing her desire to never see him again.
The expertise of the child psychiatrist
The child psychiatrist of Karamandaneio, who examined the minor, states: “This is a girl who is well developed physically for his age, with a natural mental potential, well-groomed and nice with good emotional and visual contact. The speech of the minor is spontaneous, rich and its flow is continuous, while her thinking is structured and perceptual ability very good cognitive memory language ability ability to distinguish truth from falsehood and does not present psychopathology.
The reported facts or situations by the minor do not present inaccuracies. The non-verbal behavior of the minor during the different types of questions, reveals her embarrassment and anxiety to recall in her memory, the unpleasant events for her. However, she spoke about the alleged acts against her with a spontaneous speech, a stable voice and a free narration and recall, which produces the most reliable information.
The details mentioned by the minor are considered sufficient to document the reported acts. Her statements in relation to the reported events or situations are considered credible “.
The complainant’s lawyer
For her part, the lawyer Gianna Panagopoulou, who represents the family of the minor, also referred to the behavior of the accused, who called people to support him, outside the courts but also outside the Security.
“Every accused person has the presumption of innocence, but everything must be done within the framework of the measure. Such behaviors, such as gathering people outside the courts or outside the police, are indifferent but can also create impressions. Motivating people by the accused is behavior that goes beyond measure and is done for the sake of impressing. I believe that the case has another seriousness, another level and as a defense attorney I will remain in it. The rest is judged by public opinion and not so much by justice. “
Finally, Ms. Panagopoulou made it clear that the family will take legal action regarding the leakage of the minor’s personal data. “I know, I have been informed by the family that some personal data of the minor have been leaked. “I have not received all the material, but we have been instructed to take legal action against anyone who has touched the data of a minor and has tried to insult her personality,” he said.
