In the dock of the accused before him of the Mixed Jury Court in Volos sat yesterday a 65-year-old man from Larissa, facing prosecution for abuse in carelessness and serious unintentional bodily harm at the expense of his 52-year-old partner.
The incident took place in May 2019, with the 52-year-old complaining to her partner that her he broke the nose with his fist and beat her all over the body.
She submitted herself in forensic examination by the medical examiner of Larissa, an examination which confirmed the injuries sustained by the woman, while the 65-year-old was prosecuted for domestic grievous bodily harm in relation to the wound on the nose, and domestic simple bodily harm for the other injuries.
After the 52-year-old’s hospitalization, the couple returned home together. According to the woman’s testimony, while she was sedated by the drugs and unable to reactthe 65-year-old sexually assaulted her.
“As soon as we got home from the hospital and I was still in shock, he pulled down my pants and satisfied himself sexually on me. I couldn’t react, from the pills and the injuries. He tortured me and I sued him,” she claimed.
It is not the first time that the 52-year-old accuses her partner of domestic abuse. There have been other incidents between the two partners, but the 65-year-old man has been found not guilty of those that the woman has complained about in the past and that have gone to trial.
The couple resides permanently in Larissa and have been in a relationship since 2015, with the 65-year-old having lost his first wife and the 52-year-old divorced while both have adult children from their previous marriages.
The problems they face are not few, with the 65-year-old being a chronic cannabis user and the 52-year-old facing alcoholism and mental health issues for which she is receiving medication, while her partner is reportedly the one who has taken over her care.
In his apology, the 65-year-old denied all the accusations and claimed that he is the sole support of the woman, who refuses to take her prescribed psychopharmacological treatment on her own.
He was unanimously acquitted of the charge of careless abuse, while at the request of his lawyer, Mr. Konstantinos Gousis, the second charge was changed to dangerous bodily harm for which he was unanimously declared guilty.
The court sentenced him to 2 years in prison, after the mitigating factor of sincere remorse was recognized by a majority, thanks to the 4-3 vote of the jury, although the prosecutor and the judges had recommended that it be rejected.
The sentence of the 65-year-old was suspended for three years, while he was given the right to appeal with suspensive power which he exercised, while the couple left the courthouse together to return together to their home in Larissa.n
