For today, Wednesday, March 22, the trial – in the second instance – of the case of a young foreigner, who allegedly had committed a crime against a minor boy, has been determined.

The incident in question had taken place in May 2021 in the wider area of ​​Mesara, with a negative “protagonist” being a 29-year-old shepherd, who was employed by the victim’s father. The trial of the case in the first instance took place one year ago (March 2022): The Joint Jury Court of Heraklion had sentenced the 29-year-old man from Afghanistan to 7 years in prison.

The Chronicles

The father of the minor boy employed the 29-year-old shepherd. According to the complaint, in May 2021, the young man took advantage of the child’s father’s absence, committing lewd acts against the minor. The child reported to his father what he experienced at the hands of the young shepherd and a complaint was made to the Police, who arrested the 29-year-old. It is noted that both in May 2021, and in the court of first instance, the accused claimed that he is innocent and that the child’s father denounced him, in order not to pay him the earnings owed to him. However, after his confession to the Heraklion investigator last May, the 29-year-old was remanded in custody.

The trial

The case was tried on March 22, 2022, at the Mixed Jury Court of Heraklion: The young foreigner sat in the dock accused of “committing sexual intercourse with a minor” and “violence against an employee”. The Chair found the 29-year-old guilty by a majority (6-1), sentencing him to 7 years in prison for the first offense and six months in prison for “violence against an employee”. Besides, the court decided that the young man’s appeal has no deterrent force. Therefore, the 29-year-old returned to prison.

Speaking last year to neakriti.gr, the lawyer of the 29-year-old, Mr. Giorgos Zervos, said that “the sentence imposed does not correspond to the facts. The convicted person appealed and hopes that the Court of Appeal will show the true dimension of the case and he will be acquitted”.
