Six out of ten reported incidents of violence and harassment in the workplace are employers or persons exercising a managerial right or representing the employer, according to the results of the annual report of the relevant department of the Labor Inspection.

Four out of ten cases concern another employee or another employee employed in the same company.

The vast majority (91%) of complaints concern incidents violenceverbal, physical and moral or psychological harassment and the remaining 9% in sexual harassment.

According to the data of the report for 2022 of the independent department for monitoring violence and harassment at work, 38% of the complainants-victims are men and 62% women.

Regarding the sectors of activity of the companies reporting such incidents, in descending order, they refer to trade, catering, hotels, food production-industry, transport, construction and health.

Out of a total of 151 submitted and processed complaints:

– 51 cases (34%) were resolved out of court, with appropriate and appropriate measures being taken by the complained-about company and the formulation of relevant recommendations.

– 24 cases (16%) were canceled either due to non-appearance of the complainant during the scheduled discussion or due to a written statement by the latter or because specific incidents of violence and harassment were not further analyzed during the discussion, so that they could be subject to the special procedure of article 18 of Law 4808/2021.

– In 65 cases (43%) it has been recorded – by the labor relations inspector conducting the procedure – a reasoned recommendation to appeal to the competent courts, due to conflicting claims on contested factual and legal issues, which require a judicial assessment.

– In 11 cases (7%), relevant sanctions were imposed, based on the current regulatory framework, for a total amount of 29,950 euros. In 2022, as stated in a relevant announcement, the register of employers against whom an administrative sanction has been imposed for violating the prohibition of violence and harassment at work, not only in the context of labor disputes, but also following on-site inspections, will be activated. The total fines imposed amount to 37,050 euros.
