The court ruled that “the competent bodies of the Fire Department failed to recommend the organized evacuation of citizens in time”
With a new decision of Administrative Court of First Instance of Athens assigns responsibilities to the public for dealing with the deadly fire in Eyeawarding compensation total amount 150,000 euros to relatives of a 73-year-old woman which burned at New Vundzain her attempt to escape through the flames.
The court held that “there is a causal link between the illegal conduct of the bodies of the defendant Greek State and the death of the 73-year-old”emphasizing how “the competent bodies of the Fire Department failed to recommend the organized evacuation of citizens in time, which they never examined».
The government, however, as it follows from the rationale of the multi-page court decision, puts forward the opinion that the organized evacuation of citizens was not an appropriate measure for the safe evacuation of the population, as the fire reached the settlement in less than an hour and “and they were breathing winds of intensity 10 and 11 Beaufort, which carried smoke and heat hundreds of meters in front of the front, as a result of which timely evacuation was not possible, while in and around the settlements the roads are small and labyrinthine (without curbs and with dead ends)”.
Therefore, according to the aforementioned claim of the public, a possible attempt to mass-evacuate all the inhabitants of the affected settlements, under the conditions that prevailed that day, would be ineffective and dangerous, causing panic to the citizens, who in any case would not they had a safe haven, since as it turned out later on the coastline of the area, nine people drowned, carried away by the sea currents.
Moreover, according to the Greek government, every citizen, in the context of his individual responsibility, must know and apply the instructions of the G.G.P.P for the prevention and response to emergency situations, while no plan for the organized evacuation of his settlement had been drawn up New Vujas.
In the decision it is stated that “from the document presented by the defendant Greek State 264750/Σ.60789/Α.00/26.8.2022 of the Head of the Eastern Attica Disaster Recovery Sector of the Ministry of Infrastructure and Transport, it appears that it has not been paid no amount to the claimants because of the death of their relative”.
