An announcement according to which the technical issues and remarks that had been reported in relation to e-learning have been satisfied and one last technical issue is being satisfied, issued by the Personal Data Protection Authority.
The announcement emphasizes the cooperation of the Ministry of Education with the Authority after pointing out some technical issues mainly related to the operation of e-learning and the submission of a detailed memorandum of the Ministry with additional actions and actions undertaken.
The Authority concludes that “modern distance education is compatible with the basic mission of the State, as it follows from the provisions of Article 16 of the Constitution, and is an appropriate measure to maintain the teacher-student relationship in the midst of a health crisis.”
The Ministry of Education and Religions protects the personal data of the members of the educational community, at the same time utilizing for its benefit the new technologies, especially in the midst of the unprecedented health crisis.
In detail, the announcement of the Personal Data Protection Authority:
With decision 50/2021 the Data Protection Authority had identified shortcomings in the obligations of the Ministry of Education and Religions regarding its compliance with the General Data Protection Regulation in relation to the procedures it applies for modern distance education. In the context of its responsibilities, the Authority called on the Ministry as the “controller” to make the processing operations in accordance with the provisions of the Regulation in four points, in a specific manner and within two months for the three points and four months for the fourth. .
Following the issuance of the decision, the Ministry cooperated with the Authority, in order to clarify the necessary actions to meet the requirements arising from this decision. The Ministry, with a memorandum submitted on 14/1/2022, before the expiration of the first deadline, informed the Authority about its actions in relation to the remarks of the Authority. It appears from the memorandum of the Ministry that the shortcomings for which a deadline of two months had been given are being addressed, while the satisfaction of the fourth indication is in the process of implementation.
As already pointed out in the Opinion 4/2020 of the Authority, modern distance education is compatible with the basic mission of the State, as it derives from the provisions of Article 16 of the Constitution, and is an appropriate measure to maintain the educational relationship; Student in the midst of a health crisis.
The Authority, as part of its mission, consistently seeks, during the pandemic, to ensure that fundamental rights and freedoms are not unduly affected by the unavoidable processing of personal data which involves the use of new technologies.
