The three categories of invoices in detail
Three categories of invoices of electricity with a corresponding color marking so that consumers can distinguish them, the Waste, Energy and Water Regulatory Authority (RAAEF) prefers from 1 January 2024, at which point the emergency framework established in the summer of 2022 due to the energy crisis expires.
The decision published in Diaugia after the completion of the relevant consultations specifically provides for the following tariff categories:
– Fixed throughout the duration of the contract which will be highlighted in blue.
– Fluctuating with the announcement of the price either before its implementation (e.g. the January price will be announced on January 1), or retrospectively (in the same example the January price will be finalized up to two months after the month of consumption, i.e. up to March) which will be highlighted in green. In the same context (they will also be highlighted in green) are the mixed pricing products whose price will be announced either on the first day of the month following the month of its implementation or on the first day of the third month following the month of its implementation.
– Dynamic pricing products, which can fluctuate even within the day and are offered only to consumers who have a smart meter. These will be highlighted in orange.
The new regime succeeds the emergency framework in place since last year due to the energy crisis, which included a ceiling on the compensation prices of power plants, suspension of the readjustment clause and announcement of retail prices valid each month until the 20th of the previous month. This regime has been extended and will be valid until December 31.
According to the ERAEF, the expiry of the emergency measures will lead to a wide-ranging but also substantial modification of the supply contracts, whether they were concluded before the implementation of the measures in question, or during their duration. The Authority states that suppliers must notify their customers of the amended terms in a distinct paper or electronic letter:
* of the Supply Contract until November 1, 2023 and bear the burden of proof
* the timely fulfillment of their above obligation.
It also states that the notification replaces the requirement of the Procurement Code for the express consent of the consumer if the latter does not object.
Sources of the suppliers told the Athens Agency that it would be useful to pass relevant legislation so that legal disputes do not arise, for example regarding the implementation of the Procurement Code, or the regime that will govern the contracts that were recently signed and are in force.
