Another “event of life” is simplified and digitized, in order to improve the service of citizens and create a modern state, free from bureaucratic entanglements.
This is the issuance of a consensual divorce, which can now be implemented electronically, through gov.gr.
According to a Joint Ministerial Decision of the Ministers of State and Digital Government Kyriakos Pierrakakis and Justice Costas Tsiaras, (Government Gazette Β΄6390 / 31.12.2021), the marriage can be dissolved without requiring the physical presence of the citizens at any stage of the processand without the need for a special power of attorney or a genuine signature certificate.
The JMC was issued in the framework of the National Program for Simplification of Procedures (EPAD) of the General Secretariat for Digital Governance and Simplification of Procedures.
The action is part of the Program Agreement between the Minister of Interior Makis Voridis and the Deputy Minister of Digital Government in charge of Simplification of Procedures George Georgantas as well as the respective Memorandum of Understanding signed by the General Secretaries of Likes .
The goal is digital transformation of Justicethe improvement of the quality of the provided public services, the decongestion of the Courts and the registry offices and the reduction of the bureaucratic burdens for citizens, lawyers and notaries.
All connections between the platform and the registers of the Greek State are made through the Interoperability Center of the General Secretariat of Information Systems of Public Administration of the Ministry of Digital Government.
The use of the platform is extremely simple and friendly. Those interested can enter here, or search for the service at gov.gr and in the “Family” category. The way of connection is made depending on their capacity, lawyer, notary or counterparty.
The procedure is initiated by one of the two lawyers of the interested party, who connects to the application through “Portal Olomeleia” codes and registers the number of the marriage certificate, the volume, the year, the Registry code issued by her and the surname of one of the two wives.
The application automatically retrieves through interoperability from the Citizens’ Register the data of each spouse, the type of marriage, the number of children if any and their data. If the recovery is not successful, the process cannot be started.
The lawyer who initiates the procedure also enters the text of the contract, the details of the notary who will draw up the consensual divorce, selecting from a relevant list, and the details of the contracting lawyer while the application automatically retrieves the contact details of the two lawyers, through interoperability with the platform of the Plenary Session of the Bar Associations.
At each stage of the process, the lawyers, the spouses and the notary receive updates on the progress of the divorce, while the spouses also receive a separate electronic notification to connect to approve the draft private agreement drawn up by their lawyers. and start the statutory ten-day waiting period.
At the end of the ten days, the application creates the notarial deed which is downloaded by the notary in pdf format and the spouses sign out of the application digitally. In cases where citizens do not have or do not want to issue a digital signature there is the possibility of physical signature of the notarial document.
The notary then finalizes the divorce within the application. Automatically, the notarial deed is sent to the boxes of the two spouses at gov.gr and at the same time the Citizens’ Register is updated, so that an employee of the competent registry office can proceed with the registration of the solution in the Marriage Certificate. In the case of a religious marriage, the notary also enters into the application the elements of the spiritual marriage solution issued by the spouses in a natural way.
It is worth noting that the cancellation of the procedure can be done in several stages before the final signing of the notarial deed, either by the lawyers, or by the spouses, or by the notary, with the introduction of the reason for cancellation, for which all stakeholders are informed electronically.
At the end of the process the spouses, the lawyers and the notary are informed electronically about its completion, receiving a unique code / ID.
