“Suppose that the Hotelier does not have the right to have preferences / business choice for the atmosphere that will prevail in the premises of his unit? and that he needs guidance and ‘enforcement’ from the state?”
For dissonance… in the regulations of the draft law of the Ministry of Culture, which was put up for consultation a few days ago and concerns a quota in the publicly performed musical repertoire, the hoteliers of Athens speak in their announcement.
In fact, the association states that if this becomes a law of the state in the future, it will be imposed on them ‘by law’ what music will be played (‘quota’) in hotels.
“Suppose that the Hotelier does not have the right to have preferences / business choice for the atmosphere that will prevail in the premises of his unit? and that does the state need guidance and ‘enforcement’?” the hoteliers ask.
In the meantime, they note that from 1993 when the law 2121/1993 came into force until today, the State and the Ministry of of Culture, carefully avoids creating a clear framework that regulates the relations between copyright holders and users.
Despite the absence of this framework, the hotel industry through the XEE, as it is emphasized, was led to a partial agreement with almost all of the OSDs. In fact, it has created a special electronic platform for calculating the relevant fees, to which the majority of OSDs have joined, in order to facilitate the process of payment – collection of fees. “Therefore, we expected the Ministry of Culture to intervene, in order to rationalize the related fees and to establish a clear framework for collective negotiations to determine the fees of the OSDs. If we were informed about “quota”… in public music!”, they note.
“Unfortunately, the provisions of the draft law of the Ministry of Culture are more than certain that if they are finally implemented, will be at the expense of both the beneficiaries, and the customers, and the businesses, as many hotel businesses will probably prefer to remove music from their public areas entirely, rather than once again implement a setting that we fail to perceive the purpose it serves,’ emphasized in the same announcement.
