The 3rd Section of it Council of State deemed unconstitutional the new framework established by law 4957/2022 for the academic recognition of foreign study titles by DOATAP and, due to the unconstitutionality, referred the matter to the Plenary of the CoE for final judgment.

In more detail, the 3rd Department of the CoE chaired by Vice-President Giorgos Tsimekas and rapporteur by Paredros Basil Gertsowith the 1845/2024 decision of its seven-member composition, ruled that “the provisions of n. 4957/2022, which establishes a procedure for the academic recognition of foreign degrees and defines the bodies responsible for carrying out the relevant judgments, do not constitute arrangements suitable for achieving the purpose sought by the legislator, which consists in finding the intrinsic value of these degrees and their substantial comparison with the corresponding degrees awarded by the Greek Universities”.

And this, because “his organs DOATAP to which this authority is assigned, obviously do not have the required scientific background for each degree submitted in order to make the scientific and technical judgments necessary for this recognition to decide”.

Thus, with a unanimous opinion of the 3rd Department, it was judged that the relevant provisions of the law 4957/2022 “contrary to articles 4 par. 1, 5 par. 1 and 16 of the Constitution which enshrines the principle of full self-governance of HEIs, while by majority, it was decided that paragraphs 3 and 8 of article 311 violate article 16 of the Constitution”.
