New involvement was presented in today’s proceedings before the MOE in the trial for the rape and murder of Eleni Topaloudi after the resignation of the lawyer of the accused of Albanian origin.
At the beginning of today’s proceedings, the lawyer asked for another time in order to prepare for the trial. A similar request was made on the first day of the trial on February 14, when the trial was adjourned for about a month. In the refusal of the court to grant him another month, the lawyer resigned.
Thus, the court started a process of ex-officio appointment of new lawyers, from the list of the Athens Bar Association, however, facing a refusal to take up duties to represent the accused. The first three cited moral reasons, applauded by those in the audience.
The first lawyer to be appointed told the court that the specific case assigned to her contradicts her principles. “I am Rhodia myself and in the summer I visited the place where this girl drowned. I’m the same mother and I can not take the case. “It is impossible for me,” the lawyer said amid applause from the public.
The second lawyer, who was also appointed by the court, said: “And just being here, I am very upset. “I will not perform my duties either.” The third lawyer who was appointed stated characteristically: “As a man who respects women, I can not take on this case.”
The lawyers’ refusal provoked the reaction of the prosecutor of the court, who stressed: “You know very well how our legal system works. There is a legal culture, fortunately, and every defendant has the right to defend himself, whatever he has done. However, in criminal matters, those who defend such heinous crimes have committed them. This is a shame for the legal system. This may be what the public wants, but it is not right. The human rights convention and the ECHR that you invoke so many times provide for the right to defense. If it goes that way, then no one will come. “
Eventually, the court withdrew for a long time, returning with the appointment of two new lawyers who took over the defense of the accused. The trial was adjourned until March 21.
Eleni Topaloudi’s parents asked the court to examine them on March 28 and for the court to start examining other witnesses. The court accepted their request. Only the other defendant, originally from Rhodes, was present at today’s hearing, who stated in court that he does not accept the charges: “I am not guilty. I did not do what I am accused of and I apologize. “I love and respect people,” he said.
