In their panel (number 1368/22) the judges of the Council of Criminal Courts, chaired by George Kassimis and members the first instance judges Theodora Traianidou and Niki Revythis, in 1,000 pages evaluate all the evidence included in the case file and decide on the 28 accused .

The committee orders:

* For the five officers of the Fire Brigade to conduct further interrogation with an upgraded charge that will concern the fatal exposure to danger.

* The referral to trial of 13 defendants, former regional governor, officials of the Civil Protection, Fire Brigade and mayors, before the Three-Member Criminal Court for crimes related to negligent homicide depending on their involvement, due to jurisdiction, at any stage that resulted in the tragedy. That is, in prevention, extinguishing, evacuation and rescue

* The complete acquittal of 10 accused by the Police and deputy mayors.

According to the committee, the five officers of the Fire Brigade with specific actions and their omissions “contributed to the created emergency situation which eventually resulted in the loss of 103 people”.

The judges studied and evaluated, among other things, audio documents from which it appears that the necessary aerial days were not allocated for the timely extinguishing of the fire. They also emphasize that despite the urgency of the fire, the head of the Fire Brigade was absent from his position and thus never gave the order to fly the helicopters. At the same time, they report that another high-ranking officer, although he had been ordered to go to Mati, was so late to go to the area that when he arrived, the reports of the first dead had already begun.

The judges of the Council in their decision seem to fully share the phrase of the investigator of the case in his conclusion: “The indifference shown in connection with the increased responsibility of the perpetrators “In case of fire in a residential area, of course, they depend directly, mainly on the Fire Service and not, for example, on the mayor or the Police, who obviously have a responsibility, but of a lower degree and importance.”

Based on the operative part of the parliament, the case file will be returned to the investigator Athanasios Marneris in order to ask the Prosecutor’s Office to prosecute the five officers. If the indictment is announced by the Prosecutor’s Office, the former executives of the Fire Brigade will be called to apologize for the criminal report in danger.
