From July 1, the Digital Work Card in banks and supermarkets – What the Ministry of Labor announced

From July 1, 2022, its implementation begins Digital Work Card in the branches of banks and supermarkets with more than 250 employees, while, from June 1, the first phase of implementation of “ERGANI II” begins for all companies.

According to an announcement by the Ministry of Labor and Social Affairs, the work card, enacted by law 4808/2021 on Labor Protection, ensures working hours and overtime, as it will mean daily and immediate (real-time) notification to the “ERGANI” Information System of the beginning and end of work for each employee.

For the preparation of businesses and the information of employees, the Ministry of Labor and Social Affairs announces today the basic specifications for the implementation of the new regulations.

In particular, the following are provided:

– From 1/6/2022, the inventory process of working hours begins by all companies-employers that employ employees of dependent employment. In this context, the employer will state for each employee the general information regarding the employment relationship, working hours (either fixed weekly or variable per day), extraordinary schedule changes, overtime and leave.

After the submission of the statement, the P.S. “ERGANI” will display the scheduled working hours per employee, which will be immediately available to employer and employee in digital calendar format. Employees will have direct access to it, through the myErgani mobile app or the myErgani web portal (https://myErgani.gov.gr).

– The inventory process will be completed on November 30, 2022 for all businesses, with the exception of banks and supermarkets that must, due to the application of the digital work card from July 1, have completed it by June 30.

– Companies that already use a timekeeping system will have the possibility of direct connection with the new mechanism of the work card in PS. “INSTRUMENTS”.

– The new application for mobile devices is being developed and will be available to companies myErgani CardScanner, with which the employee’s work card will be read (in the form of QR Code) upon arrival / departure from work and automatic submission of information to the PS. “INSTRUMENTS”.

Each employee’s work card will be available through the corresponding application for myErgani mobile devices for employees, which will be available in the near future.

OF BASIC IMPLEMENTATION AND IMPLEMENTATION SPECIFICATIONS FOR ACTIONS

&
Working Card – Phase 1

The Ministry of Labor and Social Affairs hereby notifies
BASIC IMPLEMENTATION SPECIFICATIONS during the 1st Phase of Implementation of ERGANI II, which will concern the ORGANIZATION OF WORKING TIME, which in turn continues with the 1st Phase of implementation of the WORK CARD.

Particularly,
From 1/6/2022 begins the inventory process of Employment Hours by all companies – employers who employ employees of dependent work, with the aim of switching to the new system of Digital Organization of Working Time and the support of the Work Card, with
o Inventory of Employment Status Data relating to Working Time
o Statement of Organization of Working Time.
The process will be completed on 30.11.2022.
However, especially for the companies that participate in the 1st phase of the WORK CARD, namely the Banks and the Supermarkets with a number of employees over 250, the deadline for the completion of the inventory process will be until 30/6/2022, since the 1st phase its implementation Work Card starts on 1/7/2022.

Specifically

1. Tool II – Digital Working Time Organization
The aim of the Digital Organization of Working Time is the recording and distribution of the Scheduled Working Hours in digital form, which will gather all the declared data for Working Hours, Overtime and Leaves.
Through the new recording system of the Working Time Organization (Schedule II), the employer will declare for each employee:
• General information regarding the Employment Relationship regarding the Working Time
• Hours of Employment, in two main categories:
o Fixed Weekly
(Schedule statement for reference week, Monday – Sunday)
o Changing Per Day (Work Schedule)
(Schedule statement in detail for each day, Interval From / To)
• Extraordinary Schedule Modifications
• Overtime
• Empty

. Scheduled Working Hours

After the elaboration of the above statements of the Employer for Hours of Work, Extraordinary Modifications of Hours, Overtime and Leaves, the new system of Organization of Working Time of PS. Instrument will display the complete Scheduled Working Hours per Employee, which will be immediately available to employer and employee in digital calendar format.
At the same time,
Employees will have direct access to the Scheduled Working Hours as stated by the employer, through the application myErgani mobile app, as well as through the myErgani web portal for informing employees (https://myErgani.gov.gr) .

Employers, through the PS. Instruments, will have access to Work Scheduling for all Employees, as well as search / control tools and procedures for submitting amending statements.
 Ways of submitting the data of Digital Time Organization Work

The new system of Organization of Working Time of PS. Instrument will use the following procedures:
1. New procedure for submitting the Statement of Employment Status data related to Working Time
2. New procedures for submitting Work Time Organization
2.1. Hours of Work – Fixed Weekly
2.2. Hours of Work – Changing Per Day
2.3. Extraordinary Modifications
2.4. Empty
3. Existing procedure E8: Announcement of Legal Overtime Employment
4. Modification of procedure E3: Recruitment Announcement (removal of schedule data)
For all the above procedures the following submission methods will be supported:
• Submission with a form to the PS. Instruments
• Submission by loading XML files in PS. Instruments
• Submission via automated programming interface – API (New)
• Individual Modification submissions via SMS

2. Digital Work Card Statements
From 1/7/2022 begins the implementation of the 1st phase of the Digital Work Card in the branches of Banks and Supermarkets with employees over 250.
The measure will then be gradually extended to all other sectors (large and small enterprises).
With the Work Card there will be daily and immediate (real time) notification to the PS. Instrument of start and end of work (real time data), for each employee.

• The companies that already use a time metering system will have the possibility of direct connection with the new mechanism of the Work Card in PS. Instruments.

• The new application for mobile devices myErgani CardScanner is being developed and will be available to companies, with which the Employees’ Work Card (in QR Code format) will be read during the arrival / departure from work and automatic submission of information to P. Σ. Instruments. The Employee Card (QR Code) of each employee will be available through the corresponding application for myErgani mobile devices for employees which will be available in the near future.

• Submissions of real employment start and end data can also be made through a form and through XML files in the PS. Instruments.

All the details of the Digital Work Card will be immediately available to employers and employees, in digital form of a calendar (Real Employment Calendar).
Employees will have easy and direct access to the data of their individual Digital Work Card, through the application myErgani mobile app, as well as through the myErgani web portal (https://myErgani.gov.gr).
Employers, through the PS. Instruments, will have access to all the data submitted by the mechanism of the Work Card, for all Employees, as well as tools for processing / searching these data.
