To be proclaimed guilty of negligent homicideby omission, requested the prosecutor of the Three-Member Misdemeanor Court of Thessaloniki for two doctors accused of the death of a 24-year-old from Keramoti, Kavalawho died in May 2017, a few days after undergoing surgery gastric band placement, because he was overweight.
The prosecutor, in her proposal, spoke about negligence in the performance of their medical duties and that is why he asked for their condemnation. The process continues with the speeches of the lawyers of the civil lawsuit and the defense, while afterwards the verdict of the Court will be announced.
The doctor who placed the gastric ring in a private clinic in Thessaloniki and a colleague from the hospital in Kavala, where the patient was treated after the complications that occurred in his health, are sitting in the seat of the Criminal Court.
For the first, the prosecutor, among other things, stated that she did not inform about the possible complications of the surgery, showing negligence and oligarchy in the postoperative stage, when the health condition of the unfortunate 24-year-old deteriorated.
As for the second, the prosecutor said she insisted on the diagnosis of pulmonary embolismalthough from the patient’s clinical picture and laboratory findings there was evidence of peritoneum.
It is recalled that his death, according to a forensic report, occurred from “multiorgan failure in peritonitis».
In their apologies, both defendants abdicated their responsibilities, denying the charge of manslaughter due to negligence attributed to them. More specifically, the doctor who placed the gastric ring pointed out that performed all appropriate medical procedures, emphasizing that he had explained to the victim the pros and cons of this operation, and informed him of possible complications. “I never said it was a routine operation. Complications occur and we take all precautionary measures. “We try to anticipate them but unfortunately we can not always avoid them,” he said.
On the other hand, his co-accused described in detail the history of the specific incident, arguing that the view he formed was “to operate on the patient considering that I have to look». He attributed to a decision of the director’s director the fact that the incident was not finally treated surgically at the hospital of Kavala, but at a clinic in Thessaloniki, where the patient was then treated. «The coordinating director insisted that the surgery not be performed at the hospital […] I could not do anything more […] I do not know if he would live, if the surgery took place in Kavala“, he said.
