The punitive vote and the danger of the “new Golden Dawn”

Golden Dawn’s appeal is ongoing and society once again watches the drama of Pavlos Fyssa’s parents who relive the murder of their child. Nine years later, the question of how those convicted of directing or participating in a criminal organization should be treated in relation to their ability to become citizens remains. With the law passed in 2021 there were restrictions.

The right to be “elected” they do not lose it until the conviction becomes final provided that they do not have the status of “chairman”, “general secretary”, “member of the management” or “representative” of the formation in which they participate. Given that in the latest opinion polls, the extreme right is now flirting with 3% (it’s around 2%), the debate has opened again. THE Ilias Kasidiaris, besides, he does not appear to have any leading position in his party so as not to be caught by the law of last spring. The possibility that the simple proportionality with which the next election will be held will reinforce lax or punitive voting leaves all possibilities open.

There have been several discussions on the issue in the party headquarters and it is possible that there will be legislative initiatives. The recent intervention of the emeritus professor of Constitutional Law at the University of Athens, Nikos Alivizatos, in “NEA” and “EF.SYN.” but also of other reputable Constitutionalists have provided fodder for a new round of debates. Mr. Alivizatos states that the Constitution does not prohibit the Parliament “until the convictions of the goldsmiths are ratified by the Areopagus, to foresee something very simple: that is, that the combinations of the “Greeks” or any other party which will include persons convicted even in the first instance for participation in a criminal organization, they are illegal and that is why they are not declared. A small addition to the electoral law is sufficient for this”.

Next steps and changes, if any, will be carefully considered. According to the current law, parties with leaders convicted of such crimes will not participate in elections and are not entitled to funding, support or promotion.
