“The sentencing decision intensifies the concerns raised about the objectivity of the judicial judgment”, diplomatic sources say, among other things
About her yesterday’s conviction by an Albanian court for the elected mayor of Heimarra Fredi Beleri, diplomatic sources emphasize the following:
1. The conviction heightens the concerns expressed about the objectivity of judicial judgment.
2. During the evidentiary stage of the trial for the two members of the Greek ethnic minority, significant contradictions emerged in the material.
3. There was a violation of the presumption of innocence because of extrinsic statements and acts that advocated conviction.
4. The final sentence is manifestly disproportionate to the extent of the alleged offence.
5. The disproportionate prison sentence holds the elected mayor hostage and keeps the defeated candidate in the mayoralty, despite the express court order months ago that mandated his immediate removal.
6. The selective application of judicial decisions and the discounting of judicial judgments are not consistent with the rule of law.
7. This is not a bilateral issue but a question of the rule of law, which as the Community acquis constitutes a clear condition for the progress of the accession procedures.
8. The Greek government is closely monitoring the case and expects a genuine objective judgment in the second instance of jurisdiction.
