It was overturned by the judicial appeals board of Lamia his temporary release from prison of the once powerful leader of Golden Dawn, Nikos Michaloliakos, and it was decided to continue his detention, as he is serving a multi-year prison sentence as a protagonist of the AXA criminal organization.

The judicial council of appeals, after the appeal that was filed, completely overturned the decision of the judicial council of Plemmeliodikon Lamia, which had decided to release Michaloliakos from prison with restrictive conditions.

The appellants who judged the case, fully adopting the prosecutorial proposal of the appeals prosecutor, decided that Nikos Michaloliakos remains unrepentant despite the trial and the heavy conviction, as with a series of articles that were taken into account, he continues to praise and support Nazi practices implemented by the hard core of his party, reaching the brutal murder of Pavlos Fyssas and a series of other criminal actions.

Michaloliakos’ stance in favor of Golden Dawn’s Nazi practices, for which he was sentenced to many years in prison, as well as many leading political figures of his party, is criticized both in the will and in the prosecutor’s proposal, and even harshly.

It should be noted here that the executives of the AXA were condemned for their Nazi practices that reached the brutal murder of Pavlos Fyssas and a series of other serious criminal crimes, such as the serious injury of Egyptian Fishermen, attacks against members of the PAME organization and others.

Michaloliakos is “in” again

The continuation of Michaloliakos’ imprisonment was decided by the Appeals Council of Lamia after the appeal that was made, when a few weeks ago, a sensation was caused by the decision of the Judicial Council of Misdemeanors of Lamia, which, despite the prosecutor’s proposal to the contrary, proceeded with his temporary dismissal , interrupting his detention.

The judicial council of Plimmeliodiki of Lamia released the once powerful leader of the AXA, imposing restrictive conditions on him, including:
– the prohibition to move outside of Attica,
– the ban on leaving the country
-as well as the prohibition to have meetings with his co-accused.

His release from prison was decided with the criminal provisions that were in force in 2018, when he was arrested after the murder of Pavlos Fyssas, while with the subsequent amendments to the criminal law, made in 2021, such a thing could not happen.

And while the judicial council released Nikos Michaloliakos from prison without criminally evaluating his pro-Nazi articles, the prosecutor he had recommended to the council was opposed to Michaloliakos’ release from prison.

In particular, the prosecutor of the first degree, as well as the court of appeals, while supporting the view that Nikos Michaloliakos typically had the conditions of the law to be released from prison, however, as noted in his proposal, there are essential conditions for which the former leader of the Nazi formation should not be released.

To this end, it is underlined, in the prosecutor’s proposal, that the lack of remorse and moral improvement of the applicant, results from an extensive article in which he appears unrepentant and declares that he is imprisoned in the context of political persecution and conspiracy, elements that make him suspected of committing and new offences.
