Apple was fined R$100 million for selling iPhone devices without chargers.
The decision, by Judge Caramuru Afonso Francisco, was published this Thursday (13), in a lawsuit filed by the Brazilian Association of Borrowers, Consumers and Taxpayers.
According to the decision, in addition to the fine for social damages, the company must deliver to consumers who purchased iPhone from October 13, 2020 USB-C type power adapters, whose voltage (20W, 35W, 67W, 96W, 140W) ensure the promised performance and recharge speed for each mobile.
Sought, Apple informed, through its press office, that it will appeal the decision and that it reinforces its commitment to its environmental positioning.
The judge also ruled that all models that the company sells in Brazil have power adapters.
In the decision, the judge writes that “it is evident that, under the justification of a ‘green initiative’, the defendant imposes on the consumer the necessary purchase of adapters that were previously supplied with the product.”
For the judge, the company acts in bad faith when using the defense of the environment to justify the sale without the porters and makes a tied sale in reverse. “There is, therefore, a clear abusive practice, as there is a conditioning of the purchase of a product so that another can work, which is not allowed by article 39, item 1 of the Consumer Protection Code.”
