In March 2020, the administration of former President Donald Trump had activated this measure, as part of the campaign to deal with the pandemic. The measure was immediate, did not allow legal recourse and did not provide for automatic return to countries of origin. There were only a few exceptions, such as for Ukrainians due to the Russian invasion, or for unaccompanied minors.
Human rights campaigners denounced it as a “violation of international law”, calling it “inhumane” that it did not allow asylum seekers to submit applications. They argue that the measure effectively forces would-be immigrants to cross the border illegally, exposing them to more danger.
